HomeMy WebLinkAbout80-174RESOLUTION NO. 80 - 174 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA DECLARING ITS INTENTION TO VACATE A PORTION OF COLLEGE AVENUE NORTH OF SEVENTEENTH STREET, APPROVING A MAP THEREOF, DIRECTING THE CLERK OF THE COUNCIL TO FILE SAID MAP, DESCRIBING THE PORTION OF SAID STREET TO BE VACATED, SETTING A PUBLIC HEARING THEREON, AND DIRECTING NOTICE THEREOF TO BE POSTED AND PUBLISHED. BE IT RESOLVED by the City Council of the City of Santa Ana: 1. Pursuant to and in accordance with the provisions of Part 3, Division 9 of the Streets and Highways Code of the State of California, this Council does hereby declare its intention to order the vacation of and to vacate that portion of College Avenue north of Seventeenth Street as more particularly described and shown on that certain document entitled "Street Abandonment No. 100," together with attached maps, a copy of which is on file with the Clerk of the Council, and more particularly described and shown on. Exhibit A, attached hereto and incorporated by reference herein. 2. That the City Council of the City of Santa Ana does hereby approve said map entitled "Street Abandonment~ No. 100," together with attached maps, as the map showing that portion of College Avenue north of Seventeenth Street which this Council declares its intention to vacate. 3. The Clerk of the Council is hereby directed to file said map in her office where the same may be examined by any and all persons desiring to do so. 4. Notice is hereby given that at the hour of 7:30 p.m. or as soon thereafter as the matter can be heard on the 3rd day of N0~ember , 1980, in the Council Chambers of the City of Santa Ana, 20 Civic Center Plaza, Santa Ana, California, a public hearing will be held by this Council at which time any and all person interested in or objecting to the proposed vacation of said street hereinabove described may appear and be heard. 5. The Clerk of the Council is hereby directed to cause this Resolution to be published at least once in "The Register," a newspaper of general circulation in the City, within fifteen (15) days after the date of adoption of this Resolution and at least ten (10) days before the date set for said hearing. 6. The Director of Public Works is hereby directed to post conspicuously, in the manner prescribed by law, notice of the adoption of this Resolution, containing a statement of the time and place of hearing hereinabove set forth, along the line of said street proposed to be abandoned. COOP R~ITY ATTORNEY RESOLUTION NO. 80-174 LEGAL DESCRIPTION ABANDONMENT OF COLLEGE AVENUE That portion of Lots 3 and 4 of the Mabury Tract in the City of Santa Aha, County of Orange, State of California, as shown on a n~p recorded inBook 165, Page 301, of Deeds, Records of Los Angeles County, California, described as follows: Beginning at the centerline intersection of Seventeenth Street and Alona Street as said intersection is shown on a map of Tract No. 1478, recorded in Book 44, Page 4, of MiscellaneouA Maps, in the Office of the County Recorder of said Orange County; thence N. 88v52'40'' E., 538.93 feet along said centerline of Seventeenth Street to a point described in a deed to the City of Santa Ana re- corded June 24, 1955, in Book 3117, Page 161, of Official Records in said office of the County Recorder, said point being the centerline intersection of Seventeenth Street and College Avenue; thence ~(. 0v47'00" E., 52.03 feet along the centerline of said College Avenue to a point on a line which is parallel with and 52.00 feet northerly of said centerline of ~eventeenth Street; said point being the TRUE POINT OF BEGINNING; thence S. 88 52'40" W., 27.00 feet along said parallel line to the westerly line of College Avenue as described in said last mentioned deed; thence N. 0 47'00" E., 257.55 feet along said westerly line to a point of cusp with a tangent curve concave northeasterly and having a radius of 180.59 feet; th~nc~ s~utheasterly 122.28 feet along said curve through a central angle of 38 47 41 to the beginning of a reverse curve, concave southwesterly and having a radius of 153.00 fe~t; thence southeasterly 103.~0 feet alongosaid curve through a central angle of 38v47'41"; thence tangent to said curve S. 0 47'00" W., 25.02 feet to the beginning of a tangent curve, concave northwesterly and having a radius of 25.00 feet, said curve also being tangent, at its southwesterly terminus, to said parallel line;othence southwesterly 38.44 feet along said curve through a central angl~ of 88 05'40" to its point of tangency with.said parallel line; thence S. 88~52'4D'' W., 22.45 feet along said parallel line to said TRUE POINT OF BEGINNING. EXCEPT therefrom that portion lying northeasterly and easterly of the following described line: Beginning at the most easterly corner of that certain spandrel-shaped parcel of land described as "Parcel 2" in the deed to the City of Santa Ana, recorded in Book 3933, Page 238, of said Official Records; thence westerly, northwesterly and northerly along the curved northeasterly boundary of said spandrel parcel to its point of tangency with the easterly line of said College Avenue; thence northerly along said easterly line to its intersection with the curve hereinabove described as have a radius of 153.00 feet.
