Hubbard, Stanley C. Gould, Jr., Dale H. Heinly, Bob Brewer, A. A. Hall Absent: Councilmen None The Pledge of Allegiance was given. Invocation was given by Reverend Robert Bonhall, Episcopal Church of the Messiah. Each member of the City Council having received copies of the Minutes of Jan%~wy 4, 1960~ reading of the Minutes w~s dispensed with and approved on motion of Councilman Hubbard, seconded by Heinly and carried. Hearing Amend.Appl. No. 303 initiated by Plann.Comm. 0rdfnance This being the date set for hearing on Amendment Application No. 303~ initiated by the Planning C~Lission, amending Sectional District Map 30-5-9, to reclassify from the R-1 District to the M-1 District, properties located on the south side of Dyer Bond, between Main and Oak Streets, described as follows: (a) That property having 330 feet of frontage on Dyer Road and extending southerly 536.60 feet, all located approximately 330 feet east of the centerline of Main Street; (b) That property having 330 feet of frontage on Dyer Road and extending southerly 668.53 feet, all located approximately 1000 feet east of the centerline of Main Street; no protests were received and the hearing was closed. On motion of Councilman Gould, seconded by Hubbard and carried, the following Ordinance entitled: "Ordinance amending Article IX of the Senta Aha Municipal Code to change district classification on Amendment Application No. 301 and amending Sectional District M~p 9-5-10" was introduced, considered and placed on file for second reading. This being the date set for hearing to establish future right-of-way lines on the west side of Broadway, between First and Wa/nut Streets, 38 feet, measured from and st right angles to the survey eenterline; on the east ~mde of Broadway, betwee~ Firct and Walnut Streets, ~2 feet, measured from and at right angles to the survey!i of,Broadway, centerline; and on both sides/ between Walnut and Main Streets, 40 feet, measured from and at r~ght angles to the survey centerline; apetition was presented~ signe~. by approximately 88 persons, protesti~ the future right-of-way lines on both sides of Broadway, between Walnut and Main Streets, and on motion of Councilman Ilubbard,: seconded by Heinly and carried, the petition was received and filed. On motion of Councilman Hubbard, seconded by B~e~.r and csrried, the follow~ng Ordinsnce entitled: "Ordinance establishing future right-of-way lines along portions of Broadway" was introduced, c0ns~dered and placed on file for second reading. This being the date set for hearing to establish future right-of-way lines on both sides of Standard Avenue, between First Street and Delhi Road, 40 feet, measured from and at right angles to the survey centerline; on both sides of Ritchey Street between McFadden Avenue and tho easterly extension of Edinger~ Street, h2 feet, meaS- ured from and at right angles to the survey centerline; and on both sides of k~ru~t!'~ Street, between French Street and Grand Avenue, ~0 feet, measured from and at righ~ sungles to the survey eenterllne. The Mayor declared a hearing will be held on the.~i adoption of future right-of-mBr lines on Standea'd Avenue; no protests ware receive~l and the hearing was closed. Elsa Armstrong, 902 Grand Avenue, presented a petition signed by nine persons objecting to the setback lines !i"Trask an~ Lair~ i~ N.E.Annex" ! Ordinance CD .' South Santa Aha i Variance Appl.No. 1236 Leslie D. Tx,,mm~ c~-~ bn Fruit Street, between French Street and Grand Avenue, and requested a postpone ment so ~that a further study could be made of the survey figures and how they would!i affect the respective properties. On motion of Councilman Brewer, seconded by bard and carried, the petition was received and filed. Nellie Rosccrans, 630 Gar- field Street, inquired about the expense of moving her building,, in the event of a street widening, end her questions were satisfactorily answered by the M~yor. Mr. H. Shugart, owner of properties at 305-311 Fruit Street, asked questions with regard to the width of the street, and his questions were satisfactorily answered by CounciLman Heinly. The hearing was closed, and on motion of Councilman Gould, seconded by Heinly and carried, the matter was continued to the meeting of Februaryi 1st. This being the date set for hearing on annexation of property consisting of 17.72 acres situated on the north side of Trask Avenue, east of Laird Street, designated "Trask and Laird N.E. Annex"; Ea~war~ E. Dumon, 1SS01 E. Trask Avenue, asked numer- ous questions as to the advantages of this annexation coming into the City of Santa &ua, and it was suggested that he make au appointment with the City Manager for any further information. On motion of Councilman Gould, seconded by Hubbard and carried, the following Ordinance entitled: "Ordinance declaring the annexation of that certain territory designated 'Trask and Laird N. E. Annex'" was introduced, considered and p~aced on file for second reading. This being the date and hour fixed by the Council in Resolution No. 59-B15 for the filing of written protests against the election ~n that certain territory designated "South Santa Aha Annex No. 2"; on motion of Councilman Gould, seconded by Hubbard and carried, the Manager and Attorney were instructed to prepare the necessary papers and maps and delete from the annexation every parcel of l~nd west of Bristol Street~ which is south of Paularino Avenue~ deleting approximately 17.6 acres from this annexation which would be the area requesting deletion by letter to the City Council signed by Messrs. Miltenburg~ O'Halloran, et al, said area being less than 5% of the total area in the annexation. The ~yor asked the Clerk if she had received, any protests, and the Clerk reported receipt of protests representing ~% of the total valuation of the area; that the area has a total assessed valuation of excluding public land, and the assessed value of the land represented by the protest- ants was found to be not more than $62~00. It was moved by Councilmen Gould, se- conded by Heinly and carried, that the protests represeuting h% of the total area be received and filed. The Mayor announced that since there was not a majority protest and as only a 4~ protest was made, that the time for filing protests would be continued for a period of ten days~ in accordance with Goverr~nent Code Section 35,120. On motion of Councilman Hubbard, seconded by Gould and carried, the matter was continued until the meeting of February l~ 1960~ and the per, ed for filing pro- tests against said election be extended to 5 P.M., January 28, 1960, to allow an additional ten days for the filing of such pretests as required by law. On motion of Councilmau Brewer~ seconded by Heinly and carried, the recommendation of the Planning Commission was approved and Variance Application No. 1236~ filed by Leslie D. Truman, to construct a garage w~th a one-bedroom apartment above, at the rear of each of two lots, on property at 2015-19 Hickory Street, in the R-1 District, was granted, in accordance with plot plan. ~ce Appl.No.1237 On motion of CounciLman Could, seconded by Hubbard and carried, the recommendation Sachio and Masako ~Nakamura 'Variance Appl.No.1238 Donald B. On motion of Councilman Gould, seconded by Hubbard and carried, the recom~aendetion of the Planning Commission was approved and Variance Application No. 1939, filed by Ora L. Williams to convert a garage into a small beauty shop on property at 1750 Willits Street, in the R-1 District, was denied. C~,~,u~ication was read from the Planning Commission recommending approval to es- tablish future right-of-way lines on Bristol Street, south of Delhi Road, from present Talbert Avenue to Delhi Road, on ~Oth sides, measured 50 feet from and at right angles to the construction centerline. The Council D~ving unanimously waived the reading of the Resolution, on motion of Councilman Hubbard, seconded by Brewer and carried, the following Resolution entitled: "Resolution No. 60-8 declaring intention to establish future right-of-way lines along Bristol Street between Talbert Avenue and Delhi Road" setting the d~te of hearing on February 15, 1960~ was considered and passed by the following vote: Ayes, C~lncilmen Noes, Councilmen Absent, Councilmen Royal E. Hall None None On motion of Councilman Hubbard, seconded by Brewer and carried, the recommendatio] of the Planning Department was approved, and Preliminary Record of Survey, filed b~ Delhi Main Industrial Park Company, creating four industrial sites, located generally Tentative Tract Map No. 3547 W. H. Charlton at the southwest corner of Delhi Road and [.~in Street, was approved, subject to conditions. Communication was again read from the Planning Department recon~nending denial of Tentative Tract Map No. B547, filed by W. H. ~harlton, creating twenty multiple- family lots, in the M-1 District, located along both sides of 5~6 feet of the prolongation of Minnie Street. Attorney Ridley C. It was moved by Councilman Gould and seconded by Brewer that the City Council declare its intention to amend the Ordinance relating to one-way traffic on Syca- more Street and establishing two-way traffic thereon, setting the date of hearing on June 6, 1960, end the City Manager be instructed to notify the Downtown Busi- nessmen's Association, Chamber of Commerce, First Street Improvement Association, and other interested groups and property owners on Sycsmore Street, to file any the reCOmmendations 'to assis~ City Coxiucil in making the changes. Motion lost. It was moved by Councilman Heinly and seconded by Hubbard that a Minute Order be spread upon the Minutes instructing the Menager: (1) That a signal be -installed at 1st and Sycamore Streets, at the earliest practicable date; (2) Consider seriously and report back with recommendation to ~xtending one-way traffic on Cypress Street to Delhi Road; (~) Consider the installation of a signal at 17th and Sycamore Streets; (~) Consider seriously extending one-way street system on Sycamore Street from McFadden Avenue to Bishop Street end northward. Hart, 232-I Spurgeon Street, pretested that since September, 1957~ the occupant of property at 2313 Spurgeon Street has been conducting a woodcutting business in an R-1 residential district, and that trucks, equipment and transientll workmen are present on the premises. Gould and carried, the Manager was instructed, when it is called to his att~n- tion, to notify any persons who are operating a business in an R-1 residential district illegally, to cease and desist.
