RESOLUTION NO. 81-1
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA REVERSING THE ACTION
OF THE PLANNING COMMISSION ON VARIANCE
APPLICATION NO. 80-33, APPROVING SAID
VARIANCE AND GRANTING APPEAL NO. 423.
WHEREAS, a public hearing was duly held before the
City Council of the City of Santa Ana on December 8, 1980,
on the action taken by the Planning Commission in denying
Variance Application No. 80-33, which application seeks to
waive zoning regulations restricting the location and height
of an existing outdoor advertising sign and a second outdoor
advertising sign to be constructed at 2140 South Ritchey
Street in the M1 District.
WHEREAS, prior to taking action on said
Conditional Use Permit Application, this Council has
reviewed and considered the Negative Declaration for
project, including Initial Study No. IS-80-129;
the
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA AS FOLLOWS:
1. That based on such public hearing and the
oral and documentary evidence submitted therein, the City
Council does hereby reverse the action of the Planning
Commission denying said Variance Application No. 80-11, and
does hereby approve said Variance and grant Appeal No. 423.
2. That the City Council
findings of fact for the approval of
following:
hereby adopts, as its
Variance No. 80-11, the
(a) Special circumstances applicable to the
subject property exist in that the existing
sign presents an unattractive view from the
rear which is improved by the construction
of the second sign.
(b) The property owner's right to obtain
maximum use of his property consistent with
the purpose and intent of the zoning regu-
lations is preserved by the granting of this
Variance.
(c) The subject sign will not have a signifi-
can~ adverse effect on property in the vicinity,
due to the circumstances of its location and
surroundings.
(d) The subject sign will not have a signifi-
cant adverse effect on the future development
of the surrounding area in accordance with the
General Plan of the City.
3. For the reasons set forth in the Negative
Declaration prepared for this project, the Council approves
and adopts the said Negative Declaration and its finding
that the project will not have a significant effect on the
environment.

4. The said Variance is approved
to the following requirements and conditions:
(1) The dimensions of the sign to be con-
structed shall not exceed 14 feet by 48 feet.
(2) The height of the sign to be constructed
shall not exceed 35 feet.
(3) The sign to be constructed shall be removed
at no cost to the City upon the expiration of
any amortization period which may hereafter be
set for such sign by the City Council.
