RESOLUTION NO. 81-2
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA REVERSING THE ACTION
OF THE PLANNING COMMISSION ON CONDITIONAL
USE PERMIT APPLICATION NO. 80-11, APPROVING
SAID CONDITIONAL USE PERMIT, AND GRANTING
APPEAL NO. 424.
WHEREAS, a public hearing was duly held before the
City Council of the City of Santa Ana on December 8, 1980,
on the action taken by the Planning Commission in denying
Conditional Use Permit Application No. 80-11, which
application seeks to allow construction of an outdoor
advertising sign and continuation of an existing outdoor
advertising sign at 2140 South Ritchey Street in the M1
District; and
WHEREAS, prior to taking action on said
Conditional Use Permit Application, this Council has
reviewed and considered the Negative Declaration for the
project, including Initial Study NO. IS-80-129;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA AS FOLLOWS:
1. That based on such public hearing and the
oral and documentary evidence submitted therein, the City
Council does hereby reverse the action of the Planning
Commission denying said Conditional Use Permit Application
No. 80-11, and does hereby approve said Conditional Use
Permit and grant Appeal No. 424.
2. That the City Council hereby adopts, as its
findings of fact for the approval of Conditional Use Permit
No. 80-11, the following:
(a) The subject sign is consistent with a
policy of providing a moderate amount of
outdoor advertising space in appropriate
locations in the City, which service con-
tributes to the general well-being of the
community.
(b) The subject sign will not have a
significant adverse effect on persons or
property in the vicinity, due to the cir-
cumstances of its location and surroundings.
(c) The subject sign will be in compliance
with all relevant zoning regulations and
conditions, as modified by Variance 80-33.
(d) The subject sign will not have a sig-
nificant adverse effect on the future
development of the surrounding area in
accordance with the General Plan of the City.
3. For the reasons set forth in the Negative
Declaration prepared for this project, the Council approves
and adopts the said Negative Declaration and its finding
that the project will not have a significant effect on the
environment.

4. The said Conditional Use Permit is approved
subject to the following requirements and conditions:
(1) The dimensions of the sign to be con-
structed shall not exceed 14 feet by 48 feet.
(2) The height of the sign to be constructed
shall not exceed 35 feet.
(3) The sign to be constructed shall be
removed at no cost to the City upon the
expiration of any amortization period which
may hereafter be set for such sign by the
City Council.
