Hubbard, Stanley C. Gould, Jr. Dale H. Heinly, Bob Brewer, Ao A. Hall Absent: Councilmen None The Pledge of Allegiance was given. Invocation was given by Mr. Harold Hinrichs of St. Peter's Lutheran Church. Each member of the City Council having received copies of the Minutes of February 15, 1960 and February 29, 1960, it was moved by Councilman Hubbard, seconded by Brewer and carried, that the Minutes of February 15, 1960, in Record Book 20, Page BS1, with reference to Preliminary Record of Survey, filed by L. and A. Thompson, be corrected to read: "that Prelim- inary Record of Survey Map be approved, the condition of dedication be presently met and that the sidewalks be constructed to the u~timate right- of-way line; said sidewalks be constructed individually as applied to the lots, to be constructed prior to the issuance of a Utilities Release, and all other conditions be deleted, striking out the word 'imposed' and sub- stituting the word 'deleted'"; also, Minutes of February 15, 9960, in Record Book 20~ Page 379, wherein Variance Application No. 1257~ filed by Rom Investment Company, was denied, after which the words "without preju- dice'' be inserted, and said Minutes, as corrected, were approved. Ordinance Hearing Establish future right-of-way lines Memory Lane and Garden Grove Blvd. Ordinance This being the date set for hearing on ~mlendment Application No. 306, filed by Southern California Edison Company, amending Sectional District Map 17-5-9, to reclassify from the R,1 to the M-1 District, certain property on the south side of McFadden Avenue, between Grand Avenue and Rltchey Street (southeast corner of Mc- Fadden and Grand Avenues ) with approximately ~00-foot frontage on McFadden Avenue and 970 feet on Grand Avenue; no protests were received and the hearing was closed. On motion of Councilman Hubbard, seconded by Gould and carried, the following Ordi- nance entitled: "Ordinance amending Article IX of the Santa Aha Municipal Code to change district classificatinn on Amena-,,nt Application No. 306 filed by the Southern California Edison Company and amending Sectional District Map 17-5-9" was introduced, considered and placed on file for second readir~. This being the date set for hearing on Amendment Application No. 307, initiated by the Planning Commnission, amending Sectional District Map 2~-5-10, to reclassify from the C to the C-1-PK District~ property bounded on the east by the center line of Flower Street, on the south by th~ center line of Glenwood Place, on the west by an alley approximately 175 feet west of the center line of Flower Street, and on the north by a line approximately 339 feet north of the center line of St. Andrew Place; no protests were received and the hearing was closed. On motion of Council- man Gould, seconded by Hubbard and carried, the following Ordinance entitled: "Ordinance amending Article IX of the Santa Arm Municipal Code to change district classification on Amendment Application No. 307 initiated by the Planning Co~mission and amending Sectional District Map No. 24-5-10" was introduced, considered and placed on file for second reading. This being the date set for hearing on Amendment Application No. 308, initiated by the Planning Ccmmuission, amending Sectional District Map 13-5-10, to reclassify frc~ the C to the C-1-PK District, property bounded on the south by the center line of McFadden Avenue, o~ the west by the center line of Bristol Street, ou the north by a line approximately 175 feet north of the center line of McFadden Avenue, and on the east by a line approximately 183 feet east of the center line of Bristol Street; and property bounded on the north by the center line of McFadden Avenue, on the west by the center line of Bristol Street, on the east by a line approxfmately 168 feet east of the center line of Bristol Street, and ou the south by a llne approximately 180 feet south of the center line of McFadden Avenue; no pretests were received and the hearin~ was closed. On motion of CounciLman Gould, seconded by B~ewer and carried, the following Ordinance entitled: "ordinance amending Article IX of the Santa Aha Municipal Code to change district classification on Amendment Application No. 308 and amendir~ Sectional District Map 13-5-10" was introduced, considered and placed on f~le for second reading. This being the date set for hearing to establish future right-of-way lines on Memory Lane and Garden Grove Boulevard, from Flower Street to the west corporate limits (approxfmately 130 fee~wast of the center line of Townley Street) measured 50 feet from and at right angles to the survey center line. Mr. L. J. Sherwin, 2730 N. Flower Street, questioned what would happen to his property at the north- west corner of Memory Lane and Flower Street, and the Manager advised the City will procure twenty feet of the property to create a line back to the adjacent property. Mr. A. F. Sckroeder~ ll20 Memory Lane, stated he is the owner of a house which projects into the future right-of-way, and was advised by the Manager that the City Would doubtless have to purchase it. The hearing was closed. On motion of Council~ man Gould, seconded by Hubbard and carried, the following Ordinance entitled: "Ordinance establishing future right-of-way lines along MemOry Lane and Garden Grove Boulevard between Flower Street and the west City limits" Hearing Establish setback lines Delhi Road and proposed Fair- view Street Ordinance was introduced, considered and placed on file for second reading. This being the date set for hearing to establish building setback lines on property located at the southeast corner of Delhi Road and proposed Fairview Street, des- cribed as follows: On the east side of Fairview Street, beginning at a point 210 feet south of the center line of Delhi Road and extending southerly 780 feet from the center line of Delhi Road, said setback line being measured 259 feet east of and at right angles to the center line of Fairview Street; and on the south side of Delhi Road beginning at a point 210 feet east of the center line of Fairview Street and extending easterly 780 feet from the center l~ne of Fairview Street, said set- back line being measured 259 feet south of and at right angles to the center line of Delhi Road; no protests were received and the hearing was closed. On motion of Hearing "Berrydale and Trask N.E.Annex" Ordinance Councilman Hubbard, seconded by Brewer and carried, the following Ordinance entitled: "Ordinance establishing setback lines along Fairview Street and Delhi Road" was introduced, considered and placed on file for second reading. This being the date set for hearing on the annexation of property consisting oS 66.~89 acres located ~a She north side of Trask Avenue between Berrydale and Laird Streets; the Clerk stated no written protests had been received. The Mayor then esked if any persons desired to be heard and there being none, he announced protests could be filed st any time before 5 P.M., March 17, 1960. On motion of Councilman Gould, seconded by Hubbard and carried, the following Ordinance entitled: Variance Appl.No.1259 Lawrence Lewis Reso.No.60-37 granting Variance "Ordinance ordering and providing for a Special Municipal Election to be held in certain territory designated 'Berrydale and Trask N.E.~nnex' on May 10, 1960, for the purpose of submitti~ to the voters of said territory the question of annexation to the City of Santa Aha" was introduced, considered and placed on file for second reading. Communication was read from the Planning Cc~mission recommending approval of Variance Application No. 1259, filed by Lawrence Lewis, to use the property at 1301-03-07-11- 15-19 South Sycamore Street, in the R-2 District, as a new and used car sales lot~ subject to conditions. Joseph M. Miller, 1336 So. Sycamore Street, stated he owns two parcels of property on the east side of Sycamore Street and was not objecting to the business, but the fence constructed along Sycamore Street was not in accord- ance with the recommendation of the Planning C~maission. Also, the three driveways on Main Street are not iu use because of parked display cars, and ingress and egress is fr~m Sycamore Street. The applicant explained he was not satisfied with the com- pleted fence, ~1A% increasirg it from the present height of 4 feet 8 inches to five feet would entail considerable expense; also, the neighbors have expressed satis- faction with the fence and have not complained about the north double driveway now in use. M. L. Hobson, 1326 So. Sycamore Street, ~tated the fence was attrsctive and the use of the double driveway on the north end was satisfactory to him. Mrs. Burrows, 1302 So. Sycamore Street, expressed her satisfaction with the appearance of the fence and advised it now cuts off an unsightly view of rubbish from a nearby store. Webb Brown, Realtor, 1701 No. Flower Street, representing the applicant, advised this is vacaut property, with orange trees, and there have been numerous health reports due to decayed fruit and weeds. His client desires to build a single-story duplex, at a cost of $18,500.00, as there are other duplexes iu the area, and the property would be too valuable, for a single-family house on it. Maurice H. Gerard, 1510 N. Rose- wood, presented a petition signed by fourteen persons, protesting a change from the R-1 to the R-2 District~ and stated this area was designated for single-family dwellings, and on motion of Councilman Hubbard, seconded by Heinly and carried, the petition was received and filed. On motion of Councilman Hubbard, seconded by Gould and carried~ the recommendation of the Planning Co~ais~ion was approved and Variance Application No. 1258 denied. C~m,~nication was read from John E. Backman, dated February 1, 1960, requesting a ninety-day extension of time on Variance Application No. ll09, which expired Feb- ~%-ry 18: 1960, to use the garage for business of new home construction on property at ~09 Linwood AVenue~ in the R-2 Distrlct~ a.n d o n motion of Councilman Gould, seconded by Hubbard and carried, the extension of time was granted. On motion of Councilman Gould, seconded by Hubbard and carried, Revised Tentative Tract Map No. 3679, filed by Henry Cox, creating llB single-family lots, located generally en the south side of Delhi Road, apprGximately 2500 feet west of Bristol Street, was approved, subject to conditions. On motion of Councilman Gould, seconded by Hubbard and carried, Revised Tentative Tract Map No. 3698, filed by Behr Process Sales, creating six industrial parcels located generally on the north side of Talbert Avenue, approximately 981 feet west of Bristol Street, was approved, subject to conditions. On motion of CounciLman Gould, seconded by Hubbard and carried, Tentative Tract Map No. 3708, filed by J. W. Lenney, creating hR single-family lots, located generally at the southeast corner of Mabury and Fruit Streets, was approved, subject to con- ditions. Communication was read from the Planni~ Department recommending approval of Tenta- tive Tract Map No. 3711, filed by ~. Richard Brown, creating 9~ single-family lots located gener%lly between McFadden and Monta Vista Avenues and 330 feet east of Sullivan Street, subject to conditions. The applicant stated he was agreeable to the conditions except condition (h), and on motion of Councilman Heinly, seconded by Gould and carried, Tentative Tract Map No. 3711 was approved, eliminating con- dition (h) and all other conditions were imposed. . On motion of Councilman Gould, seconded by Hubbard and carried, Map of Tract No. 2977, filed by Rmmet C. Rogers, for the dedication of Westwood Avenue and Santa Clara Avenue for public use for highway purposes and bond in the sum of $10,000.00 were approved~ license fee in the sum of $1,350.00 accepted, and agreement covering improvements ordered signed. Councilman Beinly disqualified himself on the following matter. The Manager presented a request from Mr. D. A. Thompson, 9531 Random Drive, Anaheim, for the installation of a stop sign at the southeast corner of Broadway and Santa Clara Avenue, on behalf of relatives residing on North Park Drive. Mr. Thumpson stated that if mechanical signals could not be installed that two stop signs would offer some protection at this corner. Communication was presented from the Planning Director advising several complaints have been received from property owners in the vicinity of Simeon ~venue and Marty Lane regarding the proposed expansion by the Orange County Flood Control District of their yard facilities adjacent on the west side of the Santa Ana River, approxi- mately 1500 feet south of Garden Grove Boulevard (Memory Lane). It was moved by Councilman Gould, seconded by Hubbard and carried, that the Orange County Flood Control District be requested not to proceed with the expansion of their yard facili- ties until data setting forth the location, purpose and extent of the proposed public improvement is submitted to the Santa Ana Planning Co~missi~for report.
