HomeMy WebLinkAbout81-003****RECINDED BY RES. 87-15 - Feb. 2, 1987'** CM:ms 12/30/80 RESOLUTION NO. 81-3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA OVERRULING THE ACTION OF THE PLANNING COMMISSION ON VARIANCE APPLICATION NO. 80-58, APPROVING SAID VARIANCE~ AND GRANTING APPEAL NO. 427. WHEREAS, a public hearing was duly held before the City Council of the City of Santa Ana on December 15, 1980, on the action taken by the Planning Commission in denying Variance Application No. 80-58, which application seeks to waive a portion of the yard and parking requirements for the development of the Orange County Rescue Center at 120 South Daisy Street in the M1 District; and WHEREAS, prior to taking action on said Variance Application, this Council has reviewed and considered the Negative Declaration for the project, including Initial Study No. IS 80-212; NOW~ THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. That based on such public hearing and the oral and documentary evidence submitted therein, the City Council does hereby reverse the action of the Planning Commission denying said Variance Application No. 80-58, and does hereby approve said Variance and grant Appeal No. 427. 2. That the City Council adopts, as its findings of fact for the approval of Variance No. 80-58, the following: (a) The strict application of the zoning ordinance is found to deprive the subject property of privileges not otherwise at variance with the intent and purpose of said ordinance due to special circumstances applicable to said property as follows: (1) The subject property, although zoned M-i, is located in a block with other uses of a general commercial nature and with nonconforming yard areas. Subject property shall be provided with a five (5) foot wide landscaped strip adjacent to the Daisy and Walnut Streets frontages, consistent with landscape requirements in commercial districts. (2) The subject property shall be provided with twelve (12) on-site parking spaces, which is adequate for the proposed use. Historically, clientele of the Rescue Center have not been motor vehicle operators and the provided spaces meet code requirements for the office and staff lodging aspects of said Rescue Center. (b) The variance is necessary to develop the subject property in order to provide a facility to serve the needs of the community. RESOLUTION NO. 81- 3 PAGE TWO (c) The variance will not be detrimental to the public welfare or injurious to surrounding property in that the facility will be designed to contribute to the community and the structure will enhance improvements in the vicinity. (d) The variance will not adversely affect the general plan of the City of Santa Ana, due to the nature of the proposed land use and subject facility which is harmonious with existing social service facilities in the immediate area and consistent with the goals and policies of the general plan for development of complimentary facilities to contribute to the general welfare and well being of the community. 3. For the reasons set forth in the Negative Declaration prepared for this project, the Council has approved the said Negative Declaration and its finding that the project will not have a significant effect on the environment. 4. The said variance is approved subject to the requirements and limitations set forth in the report of the Planning Department for the said variance, a copy of which is on file in the office of the Clerk of the Council.
