RESOLUTION NO. 81-5
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA OVERRULING THE ZONING
ADMINISTRATOR'S DENIAL OF MINOR EXCEPTION
APPLICATION 80-18, GRANTING APPEAL NO. 429
AND APPROVING MINOR EXCEPTION NO. 80-18,
AS AMENDED
WHEREAS, a public hearing was duly held before the
City Council on December 15, 1980, on the action taken by
the Zoning Administrator in denying Minor Exception Application
No. 80-18, which application seeks to allow sale of beer and
wine for off-site consumption in a proposed mini-market at
2745 West McFadden in the C4 district;
NOW, THEREFORE, BE IT RESOLVED by the City'Council
of the City of Santa Ana as follows:
1. That based on such public hearing a~d the oral
and documentary evidence submitted, the City Council does
hereby reverse the action of the Zoning Administrator, grant
Appeal 429, and approve Minor Exception No. 80-18, as amended.
2. That the City Council adopts as its findings
of fact and conditions of approval for the approval of the
said Minor Exception as Amended, that certain report entitled
"Finding of Fact Minor Exception No. 80-18," submitted by
the Zoning Administrator and on file in the office of the
Clerk of the Council with the following exceptions:
(a) That Section "6," under Details of Proposal is amended
to read as follows:
"6. The following requirements must also
be met:
A. Comply with all conditions of
Variance Application 80-56.
B. No gaming devices shall be per-
mitted on the premises at any time.
(b) That "Reason for Decision" (a) therein is amended to
read as follows:
"The proposed use is desirable as
contributing to the general well-
being of the neighborhood."
(c) That "Reason for Decison" (b) therein is amended to
read as follows:
"The proposed use will not create any
additional detrimental effect on persons
or property in the vicinity beyond that
which now exists."
