HomeMy WebLinkAbout81-055RESOLUTION NO. 81-55 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ESTABLISHING AND REGULATING FEES AND CHARGES FOR THE ADMINISTRATION AND ENFORCEMENT OF CHAPTER 8 OF THE SANTA ANA MUNICIPAL CODE WHEREAS, the City Council of the City of Santa Aha finds and determines that the fees and charges herein- after set forth are established in amounts sufficient to provide revenue equal to the costs of administration and enforcement of the provisions of Chapter 8 of the Santa Ana Municipal Code, and are reasonable and fairly allocated on the basis of burdens imposed and benefits received by the persons required to pay such fees and charges; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Ana that fees and charges for permits, planchecks, inspections, and investigations pursuant to Chapter 8, "Buildings and Structures" of the Santa Ana Municipal Code are hereby established and regulated as follows: 1 (a) GENERAL PROVISIONS Unless otherwise provided,payment of fees and charges as established herein shall be made to the Director of Building Safety {hereafter "the Director")or his authorized representatives at the time of initial application or request for the permit or service for which a fee or charge is imposed. No permit shall be issued to any person, firm, or corporation unless all fees therefor have been paid in full. (b) REFUNDS Upon written request from the permittee, refunds of permit fees may be made to the permittee in an amount equal to eighty percent (80%) of the permit fee in excess of twenty dollars ($20.00) paid; except that no permit fees shall be refunded under any of the following circumstances: (1) After one (1) year has elapsed from the date of the issuance of the permit. (2) If any inspections have been performed by the Department of Building Safety. If a permit has been issued for a project located in an area outside of the jurisdiction of the City, one hundred percent (100%) of the permit and plancheck fee may be refunded. If a duplicate permit has been erroneously issued, one hundred percent (100%) of the duplicated permit . and planchecking fee may be refunded. If a plancheck fee has been paid and the plan is withdrawn by th~ applicant prior to the plancheck, one hundred percent (100%) of the plancheck fee may be refunded. In no other case may any plancheck fees be refunded. BUILDING CODE FEES AND CHARGES (a) The butldtng permit fees and Inspection fees set forth in this resolution shall be the same as the fees stated in the 1979 Uniform Building Code (Table 3-A) to read as follows: TOTAL VALUATION $1.00 to $500.00 $501.00 to $2,000.00 $2,001.00 to $25,000.00 $25,001.00 to $50,000.00 $50,001.00 to $100,000.00 $100,001.00 and up NEW FEE 5CHEOULE TABLE 3-A FEE $10.00 $10.00 for the first $500.00 plus $1.50 for each additional $100.00 or fraction thereof, to and including $2,000.00 $32.50 for the first $2,000.00 plus $6.00 for each additional $1,000.00 or fraction thereof, to and including $2S,000.00 $170.50 for the first $25,000.00 plus $4.50 for each additional $1,000.00 or fraction thereof, to and including $50,000.00 $283.00 for the first $50,000.00 plus $3.00 for each additional $1,000.00 or fraction thereof, to and including $100,000.00 $433.00 for the first $100,000.00 plus $2.50 for each additional $1,000.00 or fraction thereof OTHER INSPECTIONS AND FEES: Inspections outside of normal business hours .......... $15.00 per hour (minimum charge - two (2) hours) Reinspection fee assessed under provisions of Section 305(g) ............................................ $15.00 each Inspections for which no fee is specifically indicated ............................................. $15.00 per hour (minimum charge - one-half (~) hour Additional plan review required by changes, additions, or revisions to approved plans ............. $15.00 per hour (minin~Jm charge - fifteen dollars ($15.00) (b) SPECIAL INVESTIGATION FEE A special investigation fee shall be charged by the Director for any investigation of a building, structure work reports, certification, or any other related work requested by an owner or his authorized agent. Said fee shall be assessed in an amount sufficient to reimbur~, th. City for the costs incurred but in no case shall be less than fifteen dollars ($15.00} (c) VIOLATION INVESTIGATION FEE Whenever any work for which a permit is required has been commenced without the authorization of such permit, an investigation may be required before a permit will be issued for such work. In addition to the regular permit fee and any penalty fee, an investigation fee shall be collected as follows: When the permit fee is: Investigation Fee $15.00 or less ....................... $10.00 More than $15.00 ..................... 25.00 (d) BUILDING RECORDS REPORT Whenever a request for information regarding a structure necessitates a search of documents, records, or plans and documentation by written report, a fee of fifteen dollars ($15.00) shall be charged for this service. (e) DEPARTMENTAL APPROVAL FOR BUSINESS LICENSE Whenever a Business License Tax Application requires processing of the "Department Approvals for Business License" form, a fee of fifteen dollars ($15.00} shall be paid to the Finance Director when the application is filed and deposited by him into Revenue Fund 411. (f) DEMOLITION PERMIT The fee for a permit to demolish a building or structure shall be fifteen dollars ($15.00). (g) APPLICATION PROCESSING AND PLANCHECKING FEES An application processing fee and planchecking fee shall be paid to the Director at the time of submitting plans for checking, Such fee shall be equal to sixty-five p'ercent (65%) of the building permit fee as set forth in this resolution. PLUMBING CODE FEES AND CHARGES (a) Plumbing Permit Fee Schedule. Any person desiring a permit required by the Plumbing Code, shall, at the time of filing an application therefor, pay a fee as required by this section. (2) Isometric drawings shall aCCCNnpany all applications for a plumbing permit. (3) When plans are required, the plancheck fee shall be fifty percent (50%) of the pl~t)tng permit fee. EXCEPTION: When eepettttous models of · tract of residential structures and their accessory buildings are submitted et one (1) time, such fee shall be paid only for each different model. 5 (4) Plancheck fee for alterations to approved plans - fifteen dollars ($15,00) per hour. Minimum charge - fifteen dollars ($15.00). 4. MECHANICAL CODE FEES AND CHARGES {a) Mechanical Permit Fee Schedule. Any person desiring a permit required by the Mechanical Code, shall, at the time of filing an application therefor, pay a fee as'~eqoir~d by this section. EXCEPTION: When repetitious models of a tract of residential structures and their accessory buildings are submitted at one (1) time, such fee shall be paid only for each different model. (3) Plancheck fee for alterations to approved plans - fifteen dollars ($15.00) per hour. Minimum charge - fifteen dollars ($15.00). e ELECTRICAL CODE FEES AND CHARGES (a) Electrical Permit Fee Schedule. Any person desiring a permit required by the Electrical Code, Shall, at the time of filing an application therefor, pay a fee as required by this section. SOLAR ENERGY CODE FEES (a) Solar Permit Fee Schedule. Any person desiring a permit required by the Solar Energy Code, shall, at the time of filing an application therefor, pay a fee as required by this section. NOTE: These fees do not include permit fees for any parts of the solar system which are subject to the requirements of other applicable Codes. SCHEDULE OF FEES For the issuance of each permit ................ $ 5.00 The minimum fee for each permit shall be fifteen dollars ($15.00), including issuance. EFFECTIVE DATE The fees and charges established by this resolution shall become effective upon the effective dates of the ordinances adopting the 1979 Editions of the Uniform Building, Plumbing, Hechanical, and Solar Codes and the 1981 Edition of the National Electrical Code for the corresponding permits and procedures undertaken pursuant to each such code respectively. Prior to such effective dates the previously established fees and charges shall continue to apply.
