HomeMy WebLinkAbout81-127REL:adg 7/Z3/81 RESOLUTION NO. 81-127 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA REVERSING THE ACTION OF THE PLANNING COMMISSION ON VARIANCE APPLICATION NO. 80-71, APPROVING SAID VARIANCE AND GRANTING APPEAL NO. 445, FOR PROPERTY LOCATED AT 1420 WEST FIFTH STREET WHEREAS, a public hearing was duly held before the City Council of the City of Santa Ana on July 20, 1981, on the action taken by the Planning Commission in denying Variance Application No. 80-71, which application seeks to allow light manufacturing warehousing and open storage at 1420 West Fifth Street in the C1 District. WHEREAS, prior to taking action on said Conditional Use Permit Application, this Council has reviewed and considered the Negative Declaration for the project, including Initial Study NO. IS-80-248; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. That based on such public hearing and the oral and documentary evidence submitted therein, the City Council does hereby reverse the action of the Planning Commission denying said Variance Application No. 80-71, and does hereby approve said Variance and grant Appeal NO. 445. 2. That the City Council hereby adopts, as its findings of fact for the approval of Variance No. 80-71, the following: (a) Special circumstances applicable to the subject property exist in that the property has long been used for manufacturing-related uses. (b) The property owner's right to obtain maximum use of his property consistent with the purpose and intent of the zoning regu- lations is preserved by the granting of this Variance. (c) The subject use will not have a signif- icant adverse effect on property in the vicinity, due to the circumstances of its location and surroundings. (d) The subject use will not have a signif- icant adverse effect on the future development of the surrounding area in accordance with the General Plan of the City. 3. For the reasons set forth in the Negative Declaration prepared for this project, the Council approves and adopts the said Negative Declaration and its finding that the project will not have a significant effect on the environment. The said Variance is approved subject to the requirements and conditions set forth as recommended requirements in that certain "Finding of Fact, Variance Application 80-71," submitted by the Planning Commission;on file in the office of the Clerk of the Council.
