RESOLUTION NO. 81-134
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA REVERSING THE ACTION
OF THE PLANNING COMMISSION ON CONDITIONAL
USE PERMIT APPLICATION NO. 81-10, APPROVING
SAID CONDITIONAL USE PERMIT, AND GRANTING
APPEAL NO. 447, FOR PROPERTY LOCATED AT
225 SOUTH GRAND AVENUE
WHEREAS, a public hearing was duly held before the
City Council of the City of Santa Aha on August 3, 1981, on
the action taken by the Planning Commission in denying
Conditional Use Permit Application No. 81-10, which
application seeks to allow construction of an outdoor
advertising sign at 225 South Grand Avenue in the M1
District; and
WHEREAS, prior to taking action on said
Conditional Use Permit Application, this Council has
reviewed and considered the Negative Declaration for the
project, including Initial Study No. IS-81-70;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA AS FOLLOWS:
1. That based on such public hearing and the
oral and documentary evidence submitted therein, the City
Council does hereby reverse the action of the Planning
Commission denying said Conditional Use Permit Application
81-10, and does hereby approve said Conditional Use Permit
and grant Appeal No. 447.
2. That the City Council hereby adopts, as its
findings of fact for the approval of Conditional Use Permit
No. 81-10, the following:
(a) The subject sign is consistent with a
policy of providing a moderate amount of
outdoor advertising space in appropriate
locations in the City, which service con-
tributes to the general well-being of
the community.
(b) The subject sign will not have a
significant adverse effect on persons or
property in the vicinity, due to the cir-
cumstances of its location and surroundings.
(c) The subject sign will be in compliance
with all relevant zoning regulations and
conditions.
(d) The subject sign will not have a sig-
nificant adverse effect on the future
development of the surrounding area in
accordance with the general Plan of the City.
3. For the reasons set forth in the Negative
Declaration prepared for this project, the Council'approves
and adopts the said Negative Declaration and its finding
that the project will not have a significant effect on the
environment.

4. The said Conditional Use Permit is approved
subject to the following requirements and conditions:
(1) Prior to obtaining a building permit
the applicant shall submit a revised set
of plans, including a landscape plan, sub-
ject to the approval of the Planning
Department, showing compliance with SAMC
section 41-619.56(c) (screening of back of
sign structure), and landscaping of
the subject property to industrial zone
standards (SAMC section 41-475).
(2) Ail development shall be according to
the approved plot plan, except for minor
modifications approved by the Planning
Department.
(3) Landscaping shall be implemented prior
to any use of the subject sign and shall
thereafter be continuously maintained.
(4) Any trash areas on the subject property
shall be enclosed in accordance with the
Planning Department standards.
(5) Five (5) years from and after the
date hereof the Planning Commission shall
determine the merits of continued use of the
subject sign with respect to changed circum-
stances, if any, brought about by new or
proposed development in the area, and changes
in City policy regarding regulation of sign-
age and development along arterial streets.
The Planning Commission may approve continued
use of the subject sign for a period not to
exceed an additional thirty (30) months, at
the end of which period this Conditional Use
Permit shall automatically terminate. If the
Planning Commission does not approve such
continuation, the matter shall be referred
to the City Council, which may either deny
any continuation, in which event this Con-
ditional Use Permit shall immediately
terminate, or may approve continued use of
the subject sign for a period not to exceed
an additional thirty (30) months, at the
end of which period this Conditional Use
Permit shall automatically terminate.
(6) Upon termination of this Conditional
Use Permit, the owner of the subject property
shall be responsible for securing removal
of the subject sign structure without expense
to the City. By accepting the benefits of

this Conditional Use Permit, such owner agrees
to City's agents entry upon the subject
property to remove the subject sign structure
and to reimburse City in full for all costs
of such removal incurred by City in removing
the sign structure, in the event such owner
fails to do so.
