WHEREAS, prior to taking action on said Variance Application, this Council has reviewed and considered the Negative Declaration for the project, including Initial Study No. IS 81-46. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. That based on such public hearing and the oral and documentary evidence submitted therein, the City Council does hereby reverse the action of the Planning Commission denying said Variance Application NO. 81-12, and does hereby approve said Variance and grant Appeal No. 451, insofar as the same pertains to waiver of trash enclosure and common storage area requirements. 2. That the City Council hereby adopts as its findings of fact for the approval of Variance No. 81-12, the following: (b) Special circumstances apply to the subject property which justify the waiver of requirements for trash enclosures and a common storage area, in that the project is designed for individual unit trash collection and storage in the same manner as conventional single family homes, and the strict application of such requirements would deprive the subject property of amenities such as open space without any corresponding benefit. (b) The granting of this variance is necessary to preserve the owner's right to develop his property in a manner consistent with the purpose and intent of the zoning regulations, in that requiring the installation of trash enclosures and a common storage area would impose an unreason- able burden on development of the property. RESOLUTION NO. 81- 154 FA6E TWO (c) Given the right to develop the property as a mobile home park conferred by Conditional Use Permit No. 81-8, the waiver of requirements for trash enclosures and a separate storage area will have no adverse impact on the public welfare or surrounding property, due to the design of the project in a manner similar to a conventional single-family home tract. (d) The General Plan of the city does not address the subjects of trash enclosures or separate storage areas, and therefore will not be adversely affected by the granting of the variance. 3. For the reasons set forth in the Negative Declaration prepared for this project, the Council approves and adopts the said Negative Declaration and its finding that the project will not have a significant effect on the environment. 4. The said variance is requirement and condition that all ments of Conditional Use Permit No. with. approved, subject to the conditions and require- 81-8 must be complied ADOPTED this _~ day of September 1981 by the following vote: AYES: MEMBERS: Acosta, Luxembourger, McGuigan, Serrato NOES: MEMBERS: Bricken, Griset, Markel ABSENT: MEMBERS: None ATTEST: /J ICE c.
