Gould, Jr. A. A. Hall Absent: Councilmen Dale H. Heinly, Bob Brewer The Pledge of Allegiance was given. Invocation was given by Reverend Joel Birmingham, First Methodist Church of Santa Ana. Each member of the City Council having received copies of the Minutes of October 3, 1960, reading of the Minutes was dispensed with and approved on motion of Councilman Hubbard, seconded by Gould and carried. Annex" Ordinance Hearing Amend.Appl.No. 32~ Elbert C. Missildine Heari~ Amend.Appl.No.~27 iL. A. Nelson, et al Ordinance bid of Westinghouse Electric Supply Company was accepted at the unit prices and in the total amount of $3,1~2.98, and all other bids rejected. On motion of Councilman Hubbard, seconded by Gould and carried, the award for the ihzrnishing and delivering of one Wheel-type Trenching Machine, Specification No. 62S-lB, was postponed until November 7, 1960. This being the date set for hearing on the annexation of property consisting of approximately 19.22 acres, located on the north side of Memory Lane, on both sides of Bristol Street; Mr. W. J. Richardson, 1~272 La Veta, Orange, orally requested information concerning the proposed annexation which would include considerable acreage of the family property on the east side of Bristol Street, and stated that although he had received a notice of the proceedings, he was not consulted about the matter and desired to know if the present C-1 zone, and the C-2 zone for the approaches, w~ld remain the same. The Mayor suggested that Mr. Richardson further discuss the matter with the Planning Department. The hearing was closed. On motio~ of Counci~m~u Gould, seconded by Hubbard and carried, the following Ordinance en- titled: "Ordinance declaring the annexatic~ of that certain territory designated 'Bristol and Memory Lane N. Annex'" was introduced, considered and placed on file for second reading. This being the date set for hearing on Amendment Application No. S23, filed by Elbert C. Missildine, amending Sectional District Map 2~-5-10, Exhibit 323-A, to reclassify from R-1 and R-2 Districts to C-2 District property described as 36 lots~ including the east side of Broadway, 480 feet south of the center line of Edinger Street, the south side of Edinger Street between Broadway and Sycamore Street, and the west side of Sycamore Street 480 feet south of the center line of Edinger Street; on motion of Councilman Hubbard, seconded by Gould and carried, the hearing was continued to November 7, 1960. Mayor Hall left the Chair. Councilman Gould assumed the Chair. This being the date set for hearing on Amendment Application No. 327, filed by L. A. Nelson, et al~ amending Sectional District Map 4-5-9, Exhibit 327-A, to reclassify from R-1 Dis- trict of the County of Orange, to the C-1 and R-3 Districts of the City of Santa Ana, property described as that area 660 feet south of Santa Clara Avenue, having 660 feet of frontage on the east side of Tustin Avenue, and being approximately 991 feet deep; no protests were received and the hearing was closed. On motion of CounciLman Hubbard and seconded by Hall, the following Ordinance entitled: "Ordinance amending Article IX of the Santa Ama Municipal Code to establish district classification on Amendment Application No. ~27 and to establish Sectional District Map 4-5-9 (Exhibit ~27-A)" following Planning Cc~mis~ion's recommendation on the westerly 3~0 feet of said property along Tustin Avenue, the C-1 classification, but disagreeing with the Planning Commission recommendation on the easterly 651 feet of said property, re- sulting in a chaB~e of said easterly portion to an R-3 District, was introduced, considered and placed on file for second reading. Appeal Appl.No. 4 Variance Appl.No.1377 H. M. Mueller Appeal Application No. h of H. M. Mueller was presented on Variance Application No. 1377, wherein Planning Commission recommended denial, to build an additional one- bedroom duplex in the rear of existing two duplexes, on property at 802 Dorman Street, in R-2 District. Applicant's Appeal states the property on Dorman Street has a frontage of 220 feet and an area of over 13,000 square feet, and is actually large enough for two separate lots above minimum square foot requirements. Farnam DeTar, 329 E. 17th Street, representing the Appelant, submitted pictures of the property, and stated his client had received approval from many residents in the area and only one objection; and further, objected to the Planning Commission's Finding of Facts, paragraph 3 concerning the special circumstances of a previous Variance No. 908, and paragraph 4 with reference to the obstruction of the view on the street with the addition of the proposed duplex. Mr. Theodore J. Garrick, 806 Dorian Street, protested the Variance for the reasons that the area is R-1 in character, and his residence would be enclosed on the entire west side; further, Communication iPlanning Commission "Delhi and Raitt - S. Cantrell Tract Map No.3921 Westport Ltd., Inc. the property already contains one duplex and a triplex, or five rentals, and would depreciate not only his property but others in the vicinity. On motion of Counci~ man Hubba~l, seconded by Gould and carried, the decision of the Planning Commissio~i was upheld, and Appeal Application No. 4, filed by H. M. Mueller, denied. Communication was again presented from the Pl2trming Cmmission recommending appro~ of proposed annexation to the City of territory designated "Delhi and Raitt .Ig~ex," located on the south side of Delhi Road, approxSmately 201 feet west of.the!! flood control channel, and consisting of 19.30k acres, and on motion of Councilm-~ Hubbard, seconded by Gould and carried, the communication was received and filed. On motion of Councilman Gould, seconded by Hubbard and carried, the following Pre- liminary Record of Survey Map and Tentative Tract Maps were approved: Preliminary Record of Survey No. 185, filed by J. M. Cantrell, creating three lots located at the northeast and northwest corners of Trask and Lewis Avenues, subject to conditions, Tentative Tract Map No. 3921, filed by Westport Ltd.,Inc., creating 70 lots located between Fairview and Sullivan Streets on the north side of Willits Street, subject to conditions, and Tract Map No.3963 Henry C. On motion of Councilman Hubbard, seconded by Gould and carried, the communication signed by the City of Santa Ana Councilmen declaring their intent and policy state-:I ment, to provide an interim contract with The Revere House owners for a temporary sewer connection pending annexation to the City of Santa Aha, was received and file~. On motion of Councilman Hubbard, seconded by Gould and carried, the written requesti signed by all of the land owners of the territory and buildings and all of the operators of the business located at the southwest corner of First Street and Tusti Avenue and operated under the name of The Revere House, for annexation and for connection to the City of Santa Aha sewers, was received and filed. It was moved by Councilman Hubbard, seconded by Gould and carried, that the terri- tory which has applied for annexation to the City of Santa Ana, and for sewerage connection, which territory is located at the southwest corner of First Street and Tustin Avenue, be granted a temporary connection to the Santa Aha sewerage system, and direct that a special temporary sewer permit be granted to them, in the firm belief that the City Council of the City of Tustin will adopt a Resolution consent- i~ng to detachment of said territory from said City as petitioned for, to avoid the Agreements Rom Investment Co.; J. W. Lenney; Land Acquisition Service Instructions Reso.No.60-205 Accept deeds Hazel E. Greenfield, Alta Mae Curnutt, et al continuation of a bad situation which affects this particular territory, which situation is rapidl~r bec~ning worse, and in fairness 8nd Justice must be corrected;' said sewer service to be furnished upon certification from the City Attorney; that the owners and operators of The Revere House have filed a proper legal action for ~he purpose of compelling deannexation of the real property upon which The Revere House is located; and further, that said owners and operators of The Revere House agree to undertake and prosecute such legal action to a final conclusion in the court of last resort in the State of California. On motion of Councilman Hubbard, seconded by Gould and carried, proper officials were authorized to execute the following agreements: With the Rcm Investment Company, dated October 17, 1960, for the recovery of cost for off-site sewer on Standard Avenue from the southerly boundary of Tract No. 3533 to a point 1875 feet south of said southerly tract boundary, the sum of $1.51 per front foot on each side of the street; and on Standard Avenue from the southerly boundary of Tract No~ 3533 to a lamphole 977 feet north of the southerly i. tract boundary, the sum of $1.51 per front foot on the west side of the street; With J. W. Green- field and Alta Mae Curnutt, for property on the south side of Eighth Street~ east of Garnsey Street, for Civic Center site, in the sum of $17,700.00, and Escrow Instructions No. ~5381-F, dated October 5, 1960, with Earl Perry and i~ Anna L. Sheflin, for property at 815 West Sixth Street, on the north side of Sixth Ii Street, east of Flower Street, for Civic Center site, in the sum of $11,03~.00, and! further the City of Santa Ana is to pay to the grantors, and through the same escroW, an additional sum of $200.00 for certain personal property, itemized in the Escrow~ Instructions. On motion of Councilman Hubbard, seconded by Gould and carried, the City Manager vas authorized to pay the Orange County Chapter of the League of California Cities,~ the sum of $150.00 as the City's share for transportation and hospitality for the visit of the Latin-American Municipal Authorities to Orange County. The Council having unanimously waived the reading of the ResOlution, on motion of Councilman Hubbard, seconded by Gould and carried, the following Resolution entitle~: "Resolution No. 60-209 declaring stop intersection" installing a Stop Sign at the intersection of Sycamore Street and Wilshire Avenue, directing traffic on Wilshire Avenue to stop to traffic on Sycamore Street, as rec~n, mended by the Department of Public Works, was considered and passed by the followi vote: Reso.No.60-RiO Remove one-hour Parking North Main St. btn First and Eighth Sts.
