Meeting called to order by the Mayor.

Invocation was given by Ralph Worsham of The Megister.
Each m~-ber of the City Council having received copies of the Minute~ of
November 21, 1960, reading of the Minutes was dispensed with and approved

This being the date set for hearing to vacate a portion of Riverine Street, between
a point 150 feet north of Eighth and Tenth Streets, Mr. C. M. Featherly, Chairman,
Orange Cmmty Board of Supervisors, stated their Resolution No. 60-931, dated
September 13, 1960, requested the abando~ent and vacatien of a porti~ of Riverine
Street, and subsequently receiyed a letter from the City Attorney advising that a
porticel of a street could no~ be vacated unless the entire street were vacated.
Mr. Featherly requested a sixty-day contin~mnce of the matter, to notify the tenants
residing between Eighth aud Tenth Streets. He further stated the County is in the
process of developing a Civic Center, and this area was finally decided upou for a
parking area for County-owned equipment and servicing, which will eventually be
housed in a five-story garage. Attorney DelBert A. Larsh, 505 First Western Bank
Building, representing Dr. Milo Tedstrcm, owner of property cm the northwest corner
of the intersection of Riverine and Eighth Streets, objected to a cc~tinuauce of the
matter, as, if the petition is illegal, it w~uld serve no purpose. The hearing was
closed. It was moved by Counci!m"~ Hubbard, seconded by Brewer and carried, that

Appeal Application No. 5 of the City Planning Department, reference Variance Appli-i
cation NO. 1396, filed by Ralph D. Mitzel, to park trucks and carryalls on property!
at 1517 Berrydale Street, in the C-1 District, stated Public Notice Cards were sent
to all present property owners within 300 feet of the exterior boundaries of the
property involved in Variance Application No. 1396, in accordance with the"ZoniD~
Ordinance of 1960." However, due to a land contract property purchase procedure,
Charles Scrofani, 1605 No. Berrydale Street and others did not receive public notices
in time to attend the Z~ning ASmtnistrator hearing on November 23, 1960, and recog-!
nizing this circumstance, the Planning Department appeals Variance Application No.
1396, in order to provide for a second public hearing before the City Council for
Mr. Scrofani and others similarly affected. Charles Scrofani stated the Variance
would be a detriment to the property owners and action should be delayed until suc~
time as the area is rezoned. It was moved by Counci~m~u Hubbard, seconded by Brewe~
and carried, that Variance Application No. 1396 be gramted, as rec.~ended by the
Planning Co~issio~, subject to conditions as imposed, and that the Planning Com-

rights on Sugar ~venue except at ~treet intersections, and bond in the sum of
$61,000.00 were approved; license fee in the amount of $2,250.00 accepted, and

Christ, creating three parcels located at the southwest corner of Santa Clara and
Grand Avenues, subject to conditions. James Sewell, 2~02 Santiago Avenue, repre-
senting the Church of Christ, questioned conditions (f) and (g) and stated that whet
Survey Mapwas filed, they were the record owners of the said three parcels, but
Variances were also granted to Southern California Edison Company and Toastmasters
International, who are now in escrow for the purchase of two of the said parcels.
Further, they are agreeable to condition (f) That the owner pay a drainage assessme~
fee of not more than $1,000.00 per acre, but because of the cha~e in ownership, th
condition (f) was discussed with the other owners who have accepted the responsibility

ference to condition (g) That the Subdivider make a $150.00 Business License Tax
payment, Mr. Sewell asked that this condition be deleted as not applicable. It was
moved by Councilman Hubbard, seconded by Brewer and carried, that Preliminary Record
of Survey Map No. 196 be approved, subject to conditions, with exception of condi-
tion (f), that in lieu thereof, an agreement be entered into between the Church of
Christ, Toastmasters International and Southern California Edison Company, whereby
each of these parties agrees to assume the drsinage assessment with respect to theix
own individual parcels, and that condition (g) be deleted.
Commmuuication dated November 30, 1960, was presented frc~ Mr. D. Canady, 8250 Beach
Boulevard, Huntington Beach, requesting Council interpretation whether item (i) That
an alley be constructed on the west side of all lots, was meant to be included as a
requirement in Council action of November 7, 1960, approving Preliminary Record of
Survey Map No. 186, filed by Joe L. Serna, creating four lots located on the north-
west corner of Newhope Street and Sugar Avenue, subject to certain conditions.
Mr. Canady, representing the applicant, stated they did not understand the require-
merit of the construction of an alley was included in the conditions imposed on the
Record of Survey Map, and requested a waiver to delay all asphalt work at this time.'
It was moved by Councilman Hubbard, seconded by Brewer and carried, that PreliminaryI
Record of Survey Nap be approved, subject to conditions as imposed; that the require~
ment of the alley was not included in these conditions and does reqUire blacktopping$~
On motion of Councilman Hubbard, seconded by Brewer and carried, Final Map of Tract
No. 3937, filed by Windsor Park, for dedication of McFadden Avenue, Lingan Lane,
Dahl Lane, Arapahoe Drive, Shawnee Drive, Mohawk Drive, Nakoma Drive, Huron Drive,
Fairview Street, Elder Avenue, Borchard Avenue and Ottawa Street, for public use
street purposes; also the drainage and sewer easements and walkway as shown on map;
and all vehicular access rights on Falrview Street and McFadden Avenue, as shown on
map are dedicated to the City; and bond in the sum of $228,000.00 were approved;

Kilroy Company was received and filed. Fire Chief Garthe stated his reasons for
objecting to cul-de-sac streets, so far as fire services are concerned, as industry
plants, using hazardous materials, have greatly increased, and it is necessary to
have access to these plants if fire services are required. On motion of Cou~c~!man
Hubbard, seconded by Brewer and carried, Final Map of Tract No. 3561 was approved,
subject to conditions (b) That the drainage assessment of $12,124.80 be paid; and

were authorized to execute agreement with Patty Lumber Company, for the recovery of
cost for off-site sanitary sewer connection on Evergreen Street from the southerly
boundary of Tract No. 3594 to a manhole 54 feet south of said southerly tract houri-
dary, the sum of $0.925 per front foot on both sides of the street; beginning at a
point on Cedar Street 610 feet south of the center line of Edinger Street to a point
769 feet south of the center line of Edinger street, a distance of 159 feet, the stm
of $1.21 per front foot on the west side of the street; beginning at a point on
Cedar Street 769 feet south of the center line of Edinger Street to a point 1,119
feet south of the center line of Edinger Street~ a distance of 350 feet; the sum of
$1.21 per front foot on both sides of the Street; beginning at a point on Cedar
Street 1,119 feet south of the center line of Edinger Street to a point 1,218 fee~!
