HomeMy WebLinkAbout82-040EJC:ar 3/1u/82 RESOLUTION NO. 82-40 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA FIXING AND ESTABLISHING THE COMPENSATION FOR THE OFFICE OF CITY ATTORNEY OF THE CITY OF SANTA ANA, AND REPEALING RESOLUTIONS INCONSISTENT THEREWITH BE IT RESOLVED by the City Council of the City of Santa Ana: I. That the salary for the office of the City Attorney of the City of Santa Ana is hereby fixed and established at the salary rate in the City of Santa Ana Salary Schedule Matrix on the effective date as herein set forth: Salary Rate Effective Date 652 7/1/82 662 1/1/83 2. The City Attorney shall be eligible for vacation compensation and bonus considerations in accordance with an evaluation system to be established by the City Council. 4. That the city shall pay to the Public Employees' Retirement System on behalf of the City Attorney an amount equal to five percent (5.0%) of the compensation upon which the retirement contributions are calculated. Payment there- of is not an increase in base salary. 5. In addition to the salary hereinabove fixed and established for said office, said officer shall receive, as additional compensation, the following employee benefits: (a) Deferred Compensation Said officer shall receive as deferred com- pensation an amount equal to one percent (1%) of his or her monthly salary. Said officer shall not have any vested right in the amounts contributed by the city until termination of employ- ment with city; il. City will pay the total amount of contributions plus any earnings thereon to said officer upon termination, resigna- tion, retirement, dismissal or death. Health Insurance The city will contribute the following amounts toward the payment of the premiums for said officer and dependents, if applicable, under the existing health insurance program (or a new program providing substantially similar coverage and benefits): 1. If the officer aforesaid does not have dependents included under the program, one hundred percent (100%) of the premiums; l~. If the officer aforesaid has dependents included under the program, an amount equal to ninety percent (90%) of the total premium applicable to the "family plan" covering said officer and his or her dependents. (c) Disability Insurance The city shall pay the full premium for a long-term disability insurance plan for said officer. (d) Dental Insurance The city shall contribute up to a maximum of Fifteen Dollars Thirty-two Cents ($15.32) per month toward the payment of premiums for dental insurance plans provided by the city for said officer and any of his or her eligible de- pendents. further RESOLUTION NO. 82-40 PAGE THREE (e) Life Insurance The city shall provide said officer with term life insurance coverage in an amount equal to twice said officer's annual rate of salary, provided said officer can provide evidence of insurability if so required. Said life insurance coverage shall include an Accidental Death and Dismemberment (AD and D) provision. The city shall pay any reasonable additional premium cost to provide such life insurance coverage at no cost to said officer. In the event that said officer is deter- mined to be ineligible for life insurance cover- age in an amount equal to twice the annual rate of salary, the city shall attempt to provide as much additional coverage above existing amounts as may be obtained without said officer having to provide evidence of insurability, but in no case shall the amount of coverage be less than the existing Twenty Thousand Dollars $20,000.00) and AD and D coverage. (f) Carry Over Benefits. In addition to the benefits specified in suDparagraphs (a) through (e) hereinabove, said officer shall receive any and all employee bene- fits accorded unrepresented executive management employees of the city who are miscellaneous mem- bers of the Public Employees' Retirement System. 6. Resolution No. 81-42 of this Council, adopted on March 21, 1981, and any and all other resolutions of this Council inconsistent herewith, are hereby repealed. ADOPTED this ]Sth day of March , 1982.
