Hubbard, Stanley C. Gould, Jr., Dale H. Heinly, Bob Brewer, A. A. Hall Absent: Councilmen None The Pledge ~f Allegiance was given. Invocation was given by Reverend Robert L. Bonhall, Church of the Messiah - Episcopal. Each member of the City Council haviB~ received copies of the Minutes of December 19, 1960 and December 28, 1960, reading of the Minutes was dispensed with and approved on motion of Councilman Hubbard, seconded by Gould and carried. Attorney William B. Harman, 401 W. Eighth Street~ appeared in favor of the zone change, and had no objection to continuing the matter until the next meeting. Webb Brown, L?O1 No. Flower Street, advised he had m~de application to the Planning Department of the City of Garden Grove to change the zone to C-1 on his property at the southwest corner of Berrydale and Trask Avenues, in November 1960, and agreed that Santa Ana and Garden Grove should, confer on the planning of this area. It was moved by Councilman Gould, seconded by Brewer and carried, that the matter be continued until January 16, 1961. This being the date set for hearing to vacate a portion of an alley south of Occi- dental Street, between Standard Avenue and Evergreen Street; no protests were re- celved and the hearing was closed. The Council having unanimously waived the read-!' ing of the Resolution, on motion of Councilmau Hubbard, seconded by Gould and carried, the following Resolution entitled: "Resolution No. 61-1 ordering vacation and abandonment of a portion of alley south of Occidental between Standard and Evergreen" was considered and passed by the following vote: Ayes, Councilmen Royal E. Hall Noes, Councilmen None Absent, Councilmen None This being the date set for hearing to vacate portions of McFadden Avenue, west of Fairview Street; no protests were received and the hearing was closed. The Council having ~nimously waived the reading of the Resolution, on motion of Councilman Gould, seconded by Hubbard and carried, the following Resolution entitled: "Resolution No. 61-2 orderiugvacation and abandonment of portions of McFadden Avenue" was considered and passed by the following vote: Ayes, Councilmen Royal E. Hall Noes, Councilmen None Absent, Councilmen None This being the date set for heariD~ on the annexation of property consisting of approximately 19 acres and situated at the northeast corner of Mabury and Seventeen~ Streets; no protests were received and the hearing was closed. On motion of Council- man Hubbard, seconded by Brewer and carried, the following Ordinance entitled: "Ordinance declaring the annexation of that certain territory designated 'Seventeenth and Mabury N. E. Annex'" was introduced, considered and placed on file for second reading. This being the date set for hearing on the annexation of property consisting of approximately 7.950 acres and located Just northeast of the northeast corner of Wright and Seventeenth Streets; no protests were received and the hearing was close~. On motion of Counc~lmau Gould, seconded by Hubbard and carried, the following Ordinance entitled: "Ordinance declaring the annexation of that certain territory designated 'Seventeenth and Mabury N. W. Annex'" Hearing Declare intention Improve Golden West Avenue, et al Assess .Dist .No.20~ Reso.No.61-3 Ordering work was introduced, considered and placed on file for second reading. The Mayor announced this is the time and place for hearing protests or objections to the proposed construction of certain improvements in Golden West Avenue and other streets, Assessment District No. 204, as described in Resolution of No. 60-249, and asked the Clerk if she was in possession of the affidavit of cation, affidavit of posting, and affidavit of mailing. The Olerk stated she had the affidavits, and on motion of Councilman Gould, seconded by Hubbard and carried the affidavits were received and filed. The ~4ayor asked the Clerk if she had re- ceived an~M wi~itten protests or objections against the work or district, and the Clerk replied no written protests had been received. The Mayor then announced thi is the time and place set for the hearing of protests or objections against the or the Assessment District, each as set forth in the Resolution of Intention before mentioned, and asked if any one present desired to be heard in said matter. No one present desired to be heard, and the hearing was closed. The Council unanimOUsly waived the reading of the Resolution, on motion of Councilman Gould, seconded by Hubbard nnd carried, the following Resolution entitled: "Resolution No. 61-B of the City Council Of the City of Santa Aha, California, ordering the work described ih Resolution of Intentinn No. 60-249, adopted on the 5th day of December, 1960, in the matter of the construction of certain i~rove- merits in Golden West Avenue and other streets (Assessment District No. 204) in said City" was considered and passed by the following vote: Reso. Hall Councilmen None Councilmen None On motion of Counci~ma~ Hubbard, seconded by Brewer and carried, proper officials were authorized to execute agreement with Voorheis-Trindle-Nelson, Civil Engineers, dated January 3, 1961, to perform all necessary engineering services, and to a competent qualified Attorney, at the Engineer's expense, to perform all legal work in connection with Assessment Districts Numbers 206-208. Appeal Application No. 6 of Harry J. Tancredi was premented on Variance App No. 1407, wherein Planning Co~ssion rec~ended denial, to erect a two-story professional office building, with a total floor area of 6,816 square feet, on property at 2006 No. Broadway, in the "P" District, and to be exempt from the re- quired three-font side yard on the south property line. Appellant stated the Zon- ing Administrator had denied Variance Application No. 1407. Harry Tancredi, 610 E. 17th Street, protested the denial, stating approximately half of the building would be occupied by the Lincoln National Life Insurance Company, for which five parking spaces are being allowed under their existing lease, und cited other Var- iances, of a similar nature, where the three-foot side yard requirements had been waived on North Broadway. F~rther, the area is Just under 5,000 square feet, thirds of which is occupied by the building and the balance of the area is to be used for parking and adequate maneuvering space. Hall None None On motion of Counci]mau Gould, seconded by Hubbard and carried, the following Ordinance entitled: "Ordinance adopting by reference an A~m~nistrative Electrical Code known as 'Orate County Administrative Electrical Code - 1959'; requiring permits for and prescribing rules and regulations governing electrical installations an~ wiring; adopting by reference those certain regulations entitled 'Electrical Safety Orders of the State of California', effective February, 1955, issued by the State of California Department of Industrial Relations, Division of Industrial Safety; providing penalties for the violation thereof, and amending Section 8300; enacting Sections 8301, 8302, 83103; and repealing ~ections 8305, 8306, 8309, 8310 a~l 8311 of Chapter 3, Article VIII of the Santa Ana Municipal Code" was introduced, considered and placed on file for second reading. Bishop a~: Seventeenth Streets, and the Department of Public Works shall install such signs and markings as are necessary to indicate to and notify drivers that left-hand turns into Seventeenth Street from Sycamore Street are prohibited. Further, there are three other one-way streets in the City which work out well, nnd this Cue would too. Mayor Hall stated he would like to see this matter be given a trial for a period of four months, to see if there has been an improvement in the traffic, and brought back before the City CoUncil in May. Swisher (carnival noise) 'On motion of Councilman Hubbard, seconded by Gould and carried, the application of the Camp Fire Girls, Orange County Council, was granted to solicit funds throu the annual peanut sale frc~ January 2Otb through February 6th, 1961. On motion of Counci!mau ltu~bard, seconded by Gould and carried, the request of Albert F. Best was granted fora City License to conduct the Broadway Billiard an Beer Parlor, BiO, North Broadway, and the written report of the Police Department was received and filed. On rec~endation of the Poli~e Department, and on motion of Councilman Hubbard, seconded by Gould and carried, the request of the California Auction School and Service was ~nted, to coeduct an auction of the furniture and appliances of the Barnett Furniture Store, 506 E. First Street, January 6th and 7th, 1961. Petitions were presented signed by approximately fifty-two persons requesting annexation to the City of territory described as ex~ending north from the south line of Fairhaven Avenue between Yorba and Santiago Avenues, and extending south from the north line of Fairhaven Avenue between Esplanade Avenue and a line Just west of Ethelbee Way, designated "Fairhaven and Esplanade West Annex." On motion of Counci~u Hubbard, seconded by Nein~yand carried, the petitions were received and filed. ~ On motion of Councilman Hubbard, seconded by Brewer and~arried, the claim of ~ the sam of M. R. Gabrlel~ 2008 Heliotrope Drive% due to malfunctioning of the traffic signal at the intersection of 17th and Flower Streets, resulting in collision of vehicles was referred to the City Attorney and Insurance Carrier. On motion of Councilman Nubbard, seconded by Neinly and carried, proper officials were authorized to execute agreement dated jan,,,wy 3, 1961, with Nathan Franklin Andrews, owner of property at 2701 West First Street, and Eebe Gerald and Carrie Brooks, lesseesof property at 2701 West First Street, wherein the City proposes to improve the street and sidewalk aloug said West First Street adjoining said pre- mises, and to provide for lowering the street and sidewalk located within the City's street right-of-way below the level of the said adjoining property and for the construction of steps from said property to the sidswalk in order to provide adequat~ access. It was moved by Councilma~ Gould, seconded by Nelnly and carried, that the Manager be instructed to direct the Police Department to station a police officer at the intersection of Broadway and 17th Street, for a period of thirty days, between 7:~5 A.M. to 8:~5 A.M. and ~:BO P.M. to 5:~5 P.M., to ~11eviate the traffic proble~ Mrs. William Swisher, 1127 Russell Avenue, orally complained that a carnival has been operating at the A & P Food Stores, 1120 So. Bristol Street, for the past seven days, between the hours of ll:00 A.M. until approx!~ately 9:BO P.M., and the noise of the generators and motors have made it difficult for the residents to remain in their homes. Also, the children visiting the carnival are exposed to the crude lance of the men operating the equipment, and, further, she was ad- vised that the carnival would again return to the area. It was moved by Councilm~ Gould, seconded by Brewer and carried~ that the verbal report be accepted, and the Manager directed to write a letter to the Manager of the Carnival and to the Manager of the A & P Food Stores, with reference to the complaint and to take some action for the future. 103 On motion of Council~w~u Gould, seconded by Hubbard and carried, the City Council adjourned.
