RESOLUTION NO. 82-62
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA IN OPPOSITION TO ASSEMBLY BILL
3011 ESTABLISHING IN LAW A RELATIONSHIP
BETWEEN CANCER IN FIREFIGHTERS AND THEIR
EMPLOYMENT
WHEREAS, injuries to firefighters under present
Workers' Compensation law encompasses any event or happening
which causes a disability and which arises out of employment,
or is industially occasioned, and disease which may be
infectious, contagious, or the product or aggravation of a
discogenic disease and includes hernia, heart trouble,
pneumonia and tuberculosis; and
WHEREAS, Assembly Bill No. 3011, introduced by
Assemblyman Art Torres, provides for inclusion in the defini-
tion of injury to active firefighters cancer which develops
or manifests itself during the period of specified employ-
ment; and
WHEREAS, Assembly Bill No. 3011 would require the
state or local fire department to bear the burden of proof
that the cancer did not arise out of or in the course of
employment; and
WHEREAS, the City of Santa Ana disapproves of
establishing in law a relationship between cancer in fire-
fighters and their employment because of the unfair burden
it places upon the City.
NOW, THEREFORE, BE IT RESOLVED BY THE City Council
of the City of Santa Ana as follows:
1. The City of Santa Ana opposes the enactment of
Assembly Bill No. 3011.

2. The Clerk of the Council is hereby directed to
forward copies of this Resolution to all Orange County
cities and all Orange County State legislators.
