Hall Absent: Councilmen None The Pledge of Allegiance was given. Invocation was given by Reverend Delwin Thigpen, Spurgeon Methodist Church. Each member of the City Council having received copies of the Minutes of March 6, 1961, reading of the Minutes was dispensed with and approved on motion of Councilman Hubbard, seconded by Helnly and carried. Ordinance Co~mmmication was presented from Attorney Dennis D. Hayden, 207 North Broadway, representing the Town and Country Villa Trailer Park, 3929 W. Fifth Avenue, stati~ there has been no change in the noise and dust created at the Kart-O-Rama Race Track, approved by Council, February 6, 1961, as a permitted usewithin the C-2 Zone The Mayor requested the City Attorney to define the Ordinance relative to this matter, and the City Attorney read Sections 6352 through 6358.6 as applicable to this situation, and stated the operators of K~rt-0-Rama should file for a permit addressed to the City Council, under this particular Section, with the requirement that signs be posted ten days prior to the date of meeting indicating a public hearing on this matter. Attorney Hayden questioned the continued operation of the Race Track without a business license, and his question was satisfactorily answere, by the City Attorney and CounciLman Heinly. Mr. F. L. Ross, co-owner of Kart-O-R~ Race Track, asked for a two-weel~continuance when their legal counsel could be pre. sent, and stated the request for a permit would be filed immediately. On the oral request of Mr. Ross, and on motion of Councilman Heinly, seconded by Gould and carried, the matter was set for hearing on April 3, 1961, subject to the filing of a written request not later than March 21, 1961, and the posting of signs ten days prior to the date of hearing. Stanley Miller, 3929 W. Fifth Street, protested the lack of sanitary facilities at the Race Track, also the presence of combustible materials, and the hours of operation from 9:00 A.M. to ll:30 P.M. It was moved by Council~Ru Goul~and seconded by Brewer, that the operation of the Race Track on week-days be restricted to the hours of ll:O0 A.M. to lO:O0 P.M., and on Sundays from l:O0 P.M. to 10:OO P.M. Gould, Jr. Absent, Councilmen None A tabulation of bids was again presented for One 85 CFM Rotary Air Compressor, Single Stage, Specification No. 623-17, and the Manager reported an investigation had been made by the Department of Public Works as to the mechanical problems in- volved in this particular equipment, and ~ecommended the acceptance of the second lowest and best bid, being the bid of Smith Booth Usher Company, in the total amo~ of $2,830.00. On moticm of Counci~mmu Hubbard, sedonded by Gould and carried, the rec~mendation of the Manager was approved and the lowest and bestbid of Smith Booth Usher Company accepted, in the total amount of $2,830.00, and all other bids rejected. This being the date set for hearing on Amendment Application No. 345, initiated by the Planning Commission, amending Sectional District Maps 27-5-10 and 3~-5-10 (Exhibit AA 345 A), to reclassify from the R-1 to the M-1 Districts, property situ~ ted south of Segerstrom Avenue, north of Huntzinger Avenue, between Greenville and the proposed Fairview Streets, and the Orange County Flood Control right-of-way; no protests were received and the hearing was closed. On motion of man Hubbard, seconded by Brewer and carried, the following Ordinance entitled: "Ordinance amending Article IX of the Santa Aha Municipal Code to change district classification on ~mendment Application No. 3~6 and amending Sectional District Map 4-5-9 (Exhibit AA 3~ A)" was introduced, considered and placed on file for second reading. This being the date set for hearing on Amendment Application No. 347, filed by the Santa Ana Board of Realtors, amending Sectional District Map 7-5-9 (Exhibit AA 347 to reclassify fr~n the R-~l and R-2 Districts to the C-5 District~ property located on the west side of Grand Avenue, between Fourteenth and Seventeenth Streets, for one lot, 66 feet wide, 680 feet south of Seventeenth Street, and including a rezon- lng proposal initiated by the Planning Cc~mission for four lots, each 66 feet wide beginning at a point 490 feet south of the center line of Seventeenth Street and continuing 264 feet south; no protests were received and the hearing was closed. On motion of Councilman Hubbard, seconded by Brewer and carried, the following Ordi nance entitled: "Ordinance amending Article IX of the Santa Ana Municipal Code to change district classification on Amendment Application No. 3~7 and amending Sectional District Map 7-5-9 (Exhibit AA 3~7 B)" was introduced, considered and placed on file for second reading. This being the date set for hearing to vacate that portion of Delhi Road outside of the new alignment of Delhi Road (now Warner Avenue)~ no protests were received and the hearing was closed. The Council having unanimously waived the reading of the Resolution, on motion of CounciLman Hubbard, seconded by Brewer and carried, the following Resolution entitled: "Resolution No. 61-70 ordering vacation of a portion of Delhi Road outside th e new alignment, now Warner was considered and passed by the following vote: Ayes, Councilmen Royal E. Milton Spaulding, Romar Builders, 2432 Newport Costa Mesa, representing the applicant, stated the property is adjoined on the west and at the rear by R-2 residences, and the additional dwelling would provide income to the applicant. On motion of Councilman Helnly, seconded by Hubbard and carried, the recommendation of the Planning Commission was approved, and Appeal Application No. 15, filed by Mrs. Vera Stone on Variance Application No. ~54, denied. On motion of Councilman Hubbard, seconded by Heinly and carried, the communication from the Planning Commission was received and filed, recommending approval of pro- posed annexation to the City of territory designated "Edinger and Raitt S. E. Eighth Street, on behalf of Gordon Deckert, requested consideration by the City Council as to the deletion of Condition No. 2: "That the propOsed warehouse building observe the required three-foot side yard in the R-2 District along the north property line of the property in question," impos~ on Variance Application No. 1455, filed by Gordon Deckert, to construct a warehous~ in the R-2 District on property at 409 South Main Street, wherein Planning Commis- sion affirmed the decision of the Zoning Administrator on March 13, 1961 to grant said Variance, subject to conditions. On motion of Councilman Hubbard, seconded by Hefnly and carried, proper officials were authorized to execute agreement with Parks and Davis, dated March 20, 1961, for the preparation of plans and specificatious for the erection of an addition to the Crew Building, in the Corporation Yard, at 730 East Warner Avenue. On motiou of Councilman Hubbard, seconded by Heinly aud carried, proper of T~cials were authorized to execute agreement with Southern California Edison Company, dated March 20~ 1961, for the relocation of power poles in Warner Avenue (Delhi Road) median strip to the park~ay area on the south side of Warner Avenue, between the limits of Fairview Street and Greenville Street. On motion of Councilman Hubbard, seconded by Gould and carried, the request of the City Employees Association, for the renewal of the existing agreement to operate the Municipal Bowl Concession for a period of one year, commencing April l, 1961 and ending March 31, 1962~ and the gross be reduced from RO% to 15% under Article IV of the agreement, and stating the reasons for the request in reduction, was re- ferred to the Manager for investigation and recom~endstion. On motion of Councilman Hubbard, seconded by Gould and carried, the request of the Junior Chamber of Commerce was granted to use the Municipal Bowl, erect a small stage on the north edge of the playing field, install a sound system, and to have access to the Bowl on April i to install the stage and at h:O0 ~oM. the morning of April ?_nd, for an Easter Sunrise Service, Easter morning, April ~, 1961, sponsored by the Junior Chamber of C~mmerce and the Union Council of Churches, and the Junior Chamber of Co~erce will be responsible for any costs incurred, necessary insurance or damage thereto. On motion of Councilman Hubbard, seconded by Gould and carried, the request of the Friends of the Santa Ana Public Library was granted to use the sidewalk leading from the front entrance of the Library to the sidewalk along West Eighth Street, for a benefit book sale, with proceeds to be used for a book Fund for the Library, on April 19, 1961. On motion of Councilman Hubbard, seconded by Heinly and carried, the Purchasing Agent was authorized to advertise for bids to furnish and deliver Traffic Signal Equipment, Luminaires and Spares, for seven intersections, Specification No. 6h3-5; bids to be opened April 3, 1961. On motion of Councilman Hubbard, seconded by Heinly and carried, the oral request of the Manager was granted to sell the City property located on the south side of WaLnut Street, east of Flower Streeb, formerly used as the Corporation Yard, and to appoint a real estate broker according to Section 2615 of the City Code. On motion of Councilman Hubbard, seconded by Heinly and carried, the written recom- mendation of the Manager, dated March 15, 1961, was approved for salary step in- creases for twenty employees, effective April l, 1961. On motion of CounciLman Hubbard, seconded by Heinly and carried, the oral request of Carl J. Thornton, City Manager, was granted to leave the State, to be absent on vacation, from March ~5 through April 2, 1961. On motion of Councilman Heinly, seconded by Hubbard and carried, the request of the Department of Public Works was approved for payment of $965.52, to William Dwight Young, construction contractor, for his cost to pave the east ten feet of the west half of McClay Street, from First Street to 345 feet south of First Street, adjacent to Oscar's Drive-in. On motion of Councilman Hubbard, seconded by Brewer and carried, the request of Carl J. Thornton, City Manager, was granted, for Ht~h Foreman,Jr., Director of Public Works to serve as Acting City Manager, during the ~4anager's absence from the State from March 25 through April 2, 1961. Santiago Creek Bridge and Owens Drive APPROVED: The Manager recm~ended that the Council take action for the removal of parking on b~bh sides of Main Street, from the Santiago Creek Bridge to Owens Drive, and stated that completion of the construction could be anticipated within a week. Josephine Reilly, 2647 No. Main Street, stated the removal of the parking area in front of her lroperty would create au inconvenience in driving off and onto her property. Dr. Donald E. Lind, owner of the North Main Veterinary Hospital, 2643 No. Main Street, opposed the removal of parking as it would be financially detri- mental to his business, and stated an alternative method should be considered. Lloyd Donelan, 315½ E. Camille Street, in the employ of Dr. Lind, protested the No Parking in front of the Veterinary Hospital, stating this ~ould curtail their business and possibly affect his continued employment. Ruth Guest, 2657 No. Main Street, stated she had dedicated her property and would consider the widening of Main Street if the other residents in the area concurred. No official action was taken on this matter.
