HomeMy WebLinkAbout82-134RESOLUTION NO. 82- 134 REL:adg 9/24/82 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING VARIANCE NO. 82-10 TO MODIFY THE REAR YARD SETBACK REQUIREMENT FOR PROPERTY LOCATED AT 1719 WEST ~DINGER AVENUE IN THE A1 DISTRICT September 20, application sou~ lights as and yard setback Agricultural) use Edinger Avenue and Exhibit , this Council held a public hearing on on Variance Application No. 82-10, which to allow 49-foot high athletic field structures at variance with the height ' ~ements of the A1 (General trict on property located at 1710 West on the map attached hereto as A, and incor ted herein by reference; and WHEREAS, prior ~taking action on the said application, this council h~s reviewed the negative declaration (I.S. No.82-69) ~repared for the project; NOW, THEREFORE, BE IT~,RESOLVED AS FOLLOWS: 1. Based on the evidence s~bmitted at the abovesaid hearing this Council finds and det~mines as follows: (a) The strict application\of the rear yard setback requirement of the A1 district~ould deprive the subject property of privileges not othe~ise at variance w~th the intent and pur. pose of said z.onin~, requirements, s~nce, due to the conditions imposed herei~below, the reduction of such setback from 25 feet to l~feet will not adversely impact neighboring property.- \~ (b) There are no special circumstan~s applicable to the subject property justifying waiver of thex~height and side yard setback requirements of the A1 Distric~ (c) The modification of the rear yar~ setback requirement is necessary to allow reasonable evening~use of the athletic field on the subject property. (d) Due to the conditions imposed hereinbelo~, a variance from the rear yard setback requirement will not be materially detrimental to the public welfare or injurious'~to surrounding property, since the adverse light and glare an~ aesthetic effects of the field lights will be mitigated to~ an insignificant level. RESOLUTION NO. 82- 134 PAGE TWO (e) The approval of this variance will not adversely affect the general plan of the City. (f) For the reasons set forth above, the negative declaration prepared for this project, with its finding that the project will not have a significant effect on the environment, is hereby approved. 2. Variance 82-10 is approved to allow athletic field lights to be installed and maintained on the subject property at variance with the rear yard setback requirements of the A1 District, subject to the following limitations, requirements, and conditions: (a) The lights shall not exceed the 35-feet height limitation of the A1 District. rear feet. (b) The lights shall be set back from both the (south) and side (west) property lines a minimum of 15 (c) Landscaping, including fast-growing non- deciduous trees of a type similar to "Ficus Retusa" interspersed with a type similar to "Eucalyptus Citriodata" shall be placed in the setback area along both the rear (south) and side (west) property lines at a density sufficient to provide an uninterrupted visual screen upon maturity. The trees shall be of sufficient size at time of planting to assure that such visual screen is achieved as rapidly as possible. (d) The lights shall be equipped with louvres, and visors on thelights shall be adjusted, in accordance with the report prepared by the lighting consultant retained by the variance applicant. (e) The lights shall not remain on, an~ the athletic field shall not be used, later than 9:00 p.m. on any day. 3. Insofar as the application for Variance 82-10 sought to allow the athletic field lights to be maintained RESOLUTION NO. 82- 134 PAGE THREE at variance with the height and side yard setback requirements of the A1 District, said application is denied.
