RESOLUTION NO. 82- 156
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA ANA APPROVING
VARIANCE NO. 82-10 TO MODIFY THE SIDE
AND REAR YARD SETBACK REQUIREMENTS FOR
PROPERTY LOCATED AT 1719 WEST
EDINGER AVENUE IN THE A1 DISTRICT
WHEREAS, this Council held a public hearing on
September 20, 1982, on Variance Application No. 82-10, which
application sought to allow 49-foot high athletic field
lights as accessory structures at variance with the height
and yard setback requirements of the A1 (General
Agricultural) use district on property located at 1710 West
Edinger Avenue and shown on the map attached hereto as
Exhibit A, and incorporated herein by reference; and
WHEREAS, prior to taking action on the said
application, this council has reviewed the negative
declaration (I.S. No.82-69) prepared for the project;
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. Based on the evidence submitted at the abovesaid
hearing this Council finds and determines as follows:
(a) The strict application of the side and rear
yard setback requirements of the A1 district would deprive
the subject property of privileges not otherwise at variance
with the intent and purpose of said zoning requirements,
since, due to the conditions imposed hereinbelow, the
reduction of the rear yard setback from 25 feet to 15 feet
and the reduction of the side yard setback from 6 feet to 18
inches will not adversely impact neighboring property.
(b) There are no special circumstances applicable
to the subject property justifying waiver of the height
requirements of the A1 District.
(c) The modification of the side and rear yard
setback requirements is necessary to allow reasonable
evening use of the athletic field on the subject property.
(d) Due to the conditions imposed hereinbelow, a
variance from the side and rear yard setback requirements
will not be materially detrimental to the public welfare or

injurious to surrounding property, since the adverse light
and glare and aesthetic effects of the field lights will be
mitigated to an insignificant level.
(e) The approval of this variance will not
adversely affect the general plan of the City.
(f) For the reasons set forth above, the negative
declaration prepared for this project, with its finding that
the project will not have a significant effect on the
environment, is hereby approved.
2. Variance 82-10 is approved to allow athletic field
lights to be installed and maintained on the subject
property at variance with the side and rear yard setback
requirements of the A1 District, subject to the following
limitations, requirements, and conditions:
(a) The lights shall not exceed the 35-feet
height limitation of the A1 District.
(b) The lights shall be set back from the rear
(south) property line a minimum of 15 feet and from the side
(west) property line a minimum of 18 inches.
(c) Landscaping, including fast-growing non-
deciduous trees of a type similar to "Ficus Retusa"
interspersed with a type similar to "Eucalyptus Citriodata"
shall be placed in the setback area along both the rear
(south) and side (west) property lines at a density
sufficient to provide an uninterrupted visual screen upon
maturity. The trees shall be of sufficient size at time of
planting to assure that such visual screen is achieved as
rapidly as possible.
(d) The lights shall be equipped with concentric
louvres~and visors on the lights shall be adjusted, in
accordance with the report prepared by the lighting
consultant retained by the variance applicant~so that the
light intensity on adjacent property shall not exceed one
foot candle measured vertically three feet above the ground.
(e) The lights shall not remain on and the
athletic field shall not be used later than 9:30 p.m. on any
day.

3. Insofar as the application for Variance 82-10
sought to allow the athletic field lights to be maintained
at variance with the height requirements of the A1 District,
said application is denied.
