A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA
ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 21
WHEREAS, by Minute Order dated December 20, 1982, a public hearing
was called for January 17, 1983 at the hour of 7:30 p.m., at the Council
Chambers of the City Hall, 22 Civic Center Plaza, Santa Ana, California, to
ascertain whether the public necessity, health, safety, or welfare requires
the removal of poles, overhead wires and associated overhead structures,
and the underground installation of wires and facilities for supplying
electrical communication or similar or associated service, for the formation
of the Underground Utility District No. 21 within that certain area of the
City described as follows:
Said certain area being bounded southerly by the south line of
MacArthur Boulevard and the City limits, bounded northerly by
a line 52 feet north of the centerline of Segerstrom Avenue,
bounded westerly and easterly by lines 70 feet from the center-
line of Harbor Boulevard, as shown on the attached Exhibit "A";
WHEREAS, notice of such hearing has been given to all affected
property owners as such are shown on the last equalized assessment roll and
to all utilities concerned in the manner and within the time required by law;
and
WHEREAS, such hearing has been duly and regularly held, and all persons
interested have been given an opportunity to be heard;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Santa Ana:
1. That pursuant to Santa Ana Municipal Code Sections 37-1 to 37-13,
the above-described area is hereby declared an Underground Utility District,
and is designated as Underground Utility District No. 21 of the City of Santa
Ana. Attached hereto, marked Exhibit "A", and hereby incorporated as a part
of this Resolution, is a map delineating the boundaries of said District.
2. That the City Council does hereby fix December 1, 1983 as the date
on which affected property owners must be ready to receive underground service,
and does hereby order the removal of all poles, overhead wires and associated
overhead structures and the underground installation of wires and facilities
for supplying electric, communication, or similar or associated service within
Underground Utility District No. 21 on or before July 1, 1984.
3. That the Clerk of the Council is hereby instructed to notify all
affected utilities and all persons owning real property within Underground
Utility District No. 21 of the adoption of this Resolution within ten (10) days
after the date of such adoption. Such notification shall be made by mailing a
copy of this Resolution, together with. a copy of said Santa Ana Municipal Code
Sections 37-1 to 37-13 to all affected property owners as such are shown on
the last equalized assessment roll and to the affected utilities.

4. That the City Council of the City of Santa Ana hereby finds and
determines as follows, upon the basis of the evidence presented at said hearing;
that the public necessity, health, safety and welfare require the removal of
poles, overhead wires and associated overhead structures within said area of the
City, and the underground installation of wires and facilities for supplying
electric, communication, and similar or associated services, so as to eliminate
hazards caused by fallen lines and poles and to improve visibility of pedestrian
traffic to vehicle drivers.
