RESOLUTION NO. 83-37
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA AUTHORIZING THE MAYOR
AND THE CLERK OF THE COUNCIL TO EXECUTE
A RIGHT-OF-WAY CERTIFICATION FOR FEDERAL
FUNDING OF PROJECT 1376, WIDENING FIRST
STREET BETWEEN BUSH AND STANDARD STREETS
WHEREAS, the City of Santa Ana is now engaged in
Project 1376, to widen First Street between Bush and
Standard Streets, which project is a Federal Aid Urban
project; and
WHEREAS, the City of Santa Ana has acquired all of
the real property necessary for the said street widening
project; and
WHEREAS, the City now desires to certify the
status of its acquisition of the right-of-way necessary for
the said street widening project to assure its receipt of
allocated federal funding in the current fiscal year for
construction costs of the said project;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA that the Mayor of the City of Santa
Ana is authorized to execute on behalf of the City that
certain "Right-of-way Certification" for the First Street
Widening Project, conforming to Exhibit A, attached hereto
and incorporated herein, and the Clerk of the Council is
authorized to attest to the same.

This will be a locally administered project and we certify
that the City of Santa Ana has been informed in writing
of Caltrans high and low risk underground facilities
policies. We are aware that the State assumes no lia-
bility for compliance or noncompliance with said policy.
6. SCHEDULE FOR REMOVAL OF IMPROVEMENTS AND OBSTRUCTIONS:
All improvements and obstructions will be removed prior to
construction by demolition contractor or as part of construct-
ion contract by clearance contractor.
7. UNAUTHORIZED ENCROACHMENTS None
8. COMPLIANCE WITH FEDERAL AND STATE REQUIREMENTS REGARDING
THE ACQUISITION OF REAL PROPERTY
All right-of-way has been acquired in accordance with Title
III of the Federal Uniform Relocation Assistance and Real
Property Acquisition Policies Act of 1970 (Public Law 91-646)
and all applicable current FHWA directives covering the
acquisitions of real property.
9. COMPLIANCE WITH RELOACTION ADVISORY ASSISTANCE AND PAYMENTS
PROVISIONS OF FEDERAL AND STATE LAW
The project has no occupied parcels, and all persons have
been relocated to decent, safe and sanitary housing or have
been offered decent, safe and sanitary housing in accordance
with the current FHWA regulations. No person displaced by
this project has been required to vacate without at least 90
days written notice.
