HomeMy WebLinkAbout2003-023 - Increase the Floor Area Ratio for the 8.75 Acres of Property Located at the Western TerminusRESOLUTION NO. 2003-023 A RESOLUTION OF THE CITY COUNCIL OF ']'HE CITY OF SANTA ANA AMENDING THE GENERAL PLAN OF THE CITY OF SANTA ANA TO INCREASE THE FLOOR AREA RATIO FOR THE 8.75 ACRES OF PROPERTY LOCATED AT THE WESTERN TERMINUS OF GARRY AVENUE BETVVEEN THE SANTA ANA RIVER AND SHANNON STREET (GPA 2003-01 ) bk:2/11/03 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The City Council of the City of Santa Ana hereby finds, determines and declares as follows: General Plan Amendment No. 2003-01 has been filed with the City of Santa Ana to increase the General Plan Land Use Element Floor Area Ratio from 0.45 to 0.50 for the approximately 8.75 acres of property located at the western terminus of Garry Avenue between the Santa Ana River and Shannon Road. The Planning Commission of the City of Santa Ana held a duly noticed public hearing on February 10, 2003 and determined by a vote of 5:0:1:1 (Nalle abstaining and Verino absent) recommended the City Council approve General Plan Amendment No. 2003-01 to increase the General Plan Land Use Element Floor Area Ratio from 0.45 to 0.50 for the approximately 8.75 acres of property located at the western terminus of Garry Avenue between the Santa Ana River and Shannon Road. The Council finds that General Plan Amendment No. 2003-01 is consistent with the General Plan, including but not limited to its policies of encouraging large manufacturing development and increasing capital investment in the City because: 1. The proposed project is consistent with the Industrial (IND) land use designation of the General Plan and the Heavy Industrial (M2) zoning district. 2. The design, configuration, and size of the proposed building and condo units being created are in conformance with all City of Santa Ana requirements and standards for the subdivision of property. 3. The property is fiat with street frontage on Garry Avenue. Resolution No. 2003-023 Page 1 of 3 The project is a common lot type development with ownership of the industrial units and common area access, parking and landscaped areas. = The site is 8.75 acres, a size that accommodates the proposed uses and well exceeds the 12,000 square feet minimum required by the Heavy Industrial (M2) zoning district. 6. There are no anticipated environmental or health impacts as a result of this project, as conditioned. The 8.75 acre site has the capacity to handle the additional 17,000 square feet of floor area (giving it a total of 190,000 square feet of floor area) and the amount of practical increase in floor area along Garry Avenue is negligible, given the character of the industrial use and the neighboring uses. Section 2. The City Council has reviewed and considered the information contained in the initial study and the negative declaration prepared with respect to this Project. The City Council has, as a result of its consideration and the evidence presented at the hearings on this matter, determined that, as required pursuant to the California Environmental Quality Act ("CEQA") and the State CEQA Guidelines, Mitigated Negative Declaration and Mitigation Monitoring Program, Environmental Review No. 2002-242, adequately addresses the expected environmental impacts of this Project. On the basis of this review, the City Council finds that there is no evidence from which it can be fairly argued that the Project will have a significant adverse effect on the environment. The City Council hereby certifies and approves the mitigated negative declaration and mitigation monitoring program and directs that the Notice of Determination be prepared and filed with the County Clerk of the County of Orange in the manner required by law. Pursuant to Title XIV, California Code of Regulations ("CCR") § 735.5(c)(1 ), the City Council has determined that, after considering the record as a whole, there is no evidence that the proposed project will have the potential for any adverse effect on wildlife resources or the ecological habitat upon which wildlife resources depend. The proposed project exists in an urban environment characterized by paved concrete, roadways, surrounding buildings and human activity. Therefore, pursuant to Fish and Game Code § 711.2 and Title XIV, CCR § 735.5(a)(3), the payment of Fish and Game Department filing fees is not required in conjunction with this project. Section 3. The City Council hereby, approves General Plan Amendment No. 2003-01 to Ana to increase the General Plan Land Use Element Floor Area Ratio from 0.45 to 0.50 for the approximately 8.75 acres of property located at the western terminus of Garry Avenue between the Santa Ana River and Shannon Road. This Resolution shall take effect immediately after its adoption by the City Council, and the Clerk of the Council shall attest to and certify the vote adopting this Resolution.
