HomeMy WebLinkAbout84-040REL:adg 3/19/84 RESOLUTION NO. 84-40 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA SUPPORTING THE ORANGE COUNTY SPECIAL DISTRICT TASK FORCE PROPOSAL TO RE- ORGANIZE CERTAIN SPECIAL DISTRICTS IN ORANGE COUNTY AND REQUESTING THE BOARD OF SUPERVISORS TO INITIATE REORGANIZATION PROCEEDINGS FOR THE PURPOSE OF DETACHING CERTAIN INHABITED TERRITORY OF THE CITY OF SANTA ANA FROM THE GARDEN GROVE SANITARY DISTRICT. WHEREAS, the Orange County Special District Task Force in its January 17, 1984 report to the Board of Supervisors iden- tified certain inefficiencies resulting from multiple govern- mental agencies providing similar municipal-type services within the corporate limits of a city; and WHEREAS, said report endorsed the full-service munic- ipality concept and recommended that the cities assume provision of certain services provided by Garden Grove Sanitary District; and WHEREAS, the Santa Ana City Council concurs with the Task Force finding that multiple governmental agencies perform- ing similar public works functions within the corporate boundaries of the City of Santa Ana contribute to the complexity of local government and may hinder the ability of city residents to readily identify and contact the agency responsible for providing service; and WHEREAS, the Santa Ana City Council believes that residents of the City of Santa Ana would benefit from a full- service municipal concept and supports the proposal of the Orange County Special District Task Force that the City assume the provi- sion of sewer maintenance services from Garden Grove Sanitary District within the corporate limits of the City; NOW, THEREFORE, BE IT RESOLVED the City Council of the City of Santa Ana does hereby: RESOLUTION NO. 84-40 PAGE TWO 1. Express its intention to assume responsibility providing the services currently provided by the Garden Grove Sanitary District within the corporate boundaries of the City of Santa Ana. for 2. Propose a change of organization in the form of a detachment of certain territory within the corporate limits of the City of Santa Ana from the Garden Grove Sanitary Dis- trict, pursuant to Division 1 of Title 6 of the Government Code. 3. Request that the reorganization be subject to the following terms and conditions: A. The fixed assests of said district within the city limits of Santa Ana be transferred to the City. B. Commencing with the first year that the re- organization is effective for property tax purposes as provided in Government Code Section 54962 all prop- erty tax revenues which would have been allocated to Garden Grove Sanitary District from the area in the corporate limits, had it remained in the district, shall be allocated to the City of Santa Ana. C. That the Garden Grove Sanitary District enter into a joint use agreement with the City of Santa Ana for the operation and maintenance of certain collector sewer lines. Said lines shall be those agreed to by RESOLUTION NO. 84- 40 PAGE THREE both parties as required in order to continue existing system operations of each jurisdiction without the construction of additional capital facilities. BE IT FURTHER RESOLVED, that the City Council of the City of Santa Ana requests that the Board of Supervisors initiate reorganization proceedings.
