RESOLUTION NO. 84-47
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA DENYING CONDITIONAL USE PERMIT
APPLICATION NO. 82-23 AND VARIANCE APPLICATION
NO. 82-24 TO ALLOW AN OFF-PREMISE ADVERTISING
SIGN ON PROPERTY LOCATED AT 800-810 EAST DYER
ROAD
WHEREAS, this Council held a public hearing on April 2,
1984 on Conditional Use Permit Application No. 82-23, to allow
an off-premise advertising sign in the M2 District and on Variance
Application No. 82-24, to allow such sign to be installed at
variance with zoning regulations restricting the installation
of such signs near freeways and restricting the height of such
signs, on property located at 800-810 East Dyer Road, which ap-
plications were brought before this Council by Appeals Nos.
485 and 486, following their denial by the Planning Commission;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SANTA ANA AS FOLLOWS:
1. Based on the evidence submitted at the abovesaid hear-
ing, this Council finds and determines as follows:
(a) The proposed sign is inconsistent with develop-
ments and improvements in the vicinity and will create a view
deleterious to the area.
(b) The proposed sign may create a significant
traffic hazard since it is designed to draw the attention of
motorists on the Newport Freeway.
(c) There are no special circumstances pertaining
to the subject property which cause any unreasonable hardship
on the property owner in being required to comply with the
zoning regulations regarding the size and location of off-
premise advertising signs.
(d) The proposed sign is inconsistent with the
policies and goals of the "Scenic Corridors" elements of the
General Plan. The Newport Freeway is a "scenic corridor"
within the scope of such element and one of the objectives
of such element is to create a positive visual image for the
City.
