HomeMy WebLinkAbout84-056REL:adg 5/9/84 RESOLUTION NO. 84-56 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APROVING MINOR EXCEPTION NO. 83-49 TO ALLOW THE SALE OF BEER AND WINE FOR ON-SITE CONSUMPTION ON PROPERTY LOCATED AT 2217 WEST FIRST STREET WHEREAS, this Council held a public hearing on May 7, 1984, on Minor Exception Application No. 83-49, to allow the sale of beer and wine in a restaurant on property located at 2217 West First Street in the C2 District; and WHEREAS, prior to taking action on the said applica- tion, this Council has reviewed the negative declaration prepared for the project; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing this Council finds and determines as follows: (a) The sale of beer and wine for on-site consumption is a service which is commonly provided by restaurants and ex- pected by their guests. This minor exception is therefore desirable to provide a service which will contribute to the general well-being of the community by promoting public con- venience. (b) The provision of beer and wine for sale for on- site consumption in the restaurant will not create any excessive concentration of establishments selling alcoholic beverages in the vicinity and will not adversely impact the crime rate in the vicinity or otherwise create any nuisance to nearby residents and businesses. Therefore, this minor exception will not be detri- mental to the health, safety or general welfare of persons residing or working in the vicinity, or injurious to property or improvements in the vicinity. (c) The sale of beer and wine for on-site consumption at the restaurant pursuant to this minor exception will not violate any regulations or conditions of the zoning chapter of the municipal code nor adversely affect the general plan of the city. RESOLUTION NO. 84-56 PAGE TWO (d) For the reasons set forth in the Initial Study, the negative declaration prepared for this project, with its finding that the project will not have a significant effect on the environment, is hereby approved. 2. Minor Exception No. 83-49 is approved to allow the sale of beer and wine for on-site consumption at a restaurant on the subject property, subject to the following limitations, requirements, and conditions: (a) That development be according to the approved site plan, except for minor modifications approved by the Director of Planning and Development Services. (b) That any trash areas be enclosed in accordance with the standards of the Planning and Development Service Department. (c) That development be in accordance with all building safety and fire protection code requirements. (d) That the business remain licensed by the State as a bona fide eating establishment. (e) That a landscape plan be submitted to and approved by the Director of Planning and Development Services and that landscaping be continuously maintained in accordance with the approved plan.
