RESOLUTION NO. 84- 97
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA APROVING MINOR EXCEPTION NO. 84-19
TO ALLOW THE SALE OF BEER AND WINE FOR OFF-SITE
CONSUMPTION ON PROPERTY LOCATED AT 1134 WEST
FIRST STREET
WHEREAS, this Council held a public hearing on
August 6, 1984, on Minor Exception Application No. 84-19,
to allow the sale of beer and wine in an existing mini-market
located on property located at 1134 West First Street in the
C1 District; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid
hearing this Council finds and determines as follows:
(a) The sale of beer and wine in package form for
off-site consumption is a service which is commonly provided by
neighborhood convenience markets and expected by their
customers. This minor exception is therefore desirable to
provide a service which will contribute to the general well-
being of the community by promoting shopping convenience.
(b) The provision of beer and wine for sale for off-
site consumption in the neighborhood convenience market will not
create any excessive concentration of establishments selling
alcoholic beverages in the vicinity and will not adversely impact
the crime rate in the vicinity or otherwise create any nuisance
to nearby residents and businesses. Therefore, this minor exception
will not be detrimental to the health, safety or general welfare
of persons residing or working in the vicinity, or injurious to
property or improvements in the vicinity.
(c) The sale of beer and wine for off-site consumption
at the market pursuant to this minor exception will not violate
any regulations or conditions of the zoning chapter of the munici-
pal code nor adversely affect the general plan of the city.

2. Minor Exception No. 84-19 is approved to allow the
sale of beer and wine for off-site consumption at a neighborhood
convenience market on the subject property, subject to the follow-
ing requirements, and conditions:
(a) That development be according to the approved
site plan, except for minor modifications approved by the
Director of Planning and Development Services.
(b) That any trash areas be enclosed in accordance
with the standards of the Planning and Development Service
Department.
(c) That development be in accordance with all
building safety and fire protection code requirements.
(d) That there be no game devices on the property.
(e) That there be compliance with all the limita-
tions, requirements and conditions set forth in Exhibit A,
attached hereto and incorporated herein.

A. Planning
1. Business hours are to remain Monday through Sunday, 7:30 A.M.
to lO:DO P.M.
2. No window signage to advertise alcoholic beverages.
3. A permanent refuse enclosure shall be constructed in accordance
with Municipal Code Standards.
B. Development Processing
Floor plans and building permits are required for any proposed
alterations, interior partitions, new coolers, etc.
Police
Must comply with the provisions of Chapter 8, Article II,
Division 3 of the Santa Ana Municipal Code. (Building
Ordinance)
Upgraded security lighting requirements:
a)
Exterior doorways shal] be equipped with a lighting
device capable of provi¢ing a minimum maintained, one
footcandle of light at the base of the door.
b)
All walkways and aisles shall be equipped with a lighting
device capable of providing a minimum maintained one
footcandle of light between lights.
c)
Open parking lots shall be provided with a minimum
maintained five footcandle of light on parking surface
from dusk until dawn.
d)
All exterior lights must be equipped with vandal
resistant covers. Light shall not shine away from
subject property.
3. Special requirements:
a)
The pedestrian door needs to be reinforced with an
armored strikeplate.
An approved products list is available through this Police
Department which supplies information on tested products approved
for use i,n compliance with the City's Building Security Ordinance.
