HomeMy WebLinkAbout84-098REL:adg 8/9/84 RESOLUTION NO. 84-98 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING TENTATIVE MAP NO. 11921 WHEREAS, this Council held a duly noticed public hearing on August 6, 1984, on Tentative Map No. 11921 to allow the con- version of an apartment complex located at 521-591 North Tustin Avenue from single ownership to a form of ownership where each multiple family building is separately owned and the grounds are owned in common by the building owners; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. This Council finds and determines as follows: (a) Even though division of ownership as proposed for the subject property may be a "condominium project" under a strict interpretation of such term as used in the Subdivision Map Act, it is not a conversion of rental units to condominiums and will not cause a displacement of tenants. Nevertheless, the City and the Subdivider have complied with the notice require- ments set forth in the Subdivision Map Act for condominium conversions to the extent they can be considered to have any resonable application to a "buildings only" condominium conver- sion. (b) Bach of the tenants of the proposed condominium has received, pursuant to Section 66452.9 of the Subdivision Map Act, written notice of intention to convert at least sixty (60) days prior to the filing of Tentative Map No. 11921 with the City of Santa Ana. (c) Each such tenant has received ten (10) days written notification that an application for a public report will be, or has been, submitted to the Department of Real Estate, and that such report will be available on request. RESOLUTION NO. 84- 98 PAGE TWO (d) Each such tenant and each person applying for the rental of a unit in such residential real property, has, or will have received all applicable notices and rights now or hereafter required by Chapters 2 and 3 of the Subdivision Map Act. (e) Each such tenant will be given written notifi- cation within ten (10) days of approval of a final map for the proposed conversion. (f) The following notices specified in Section 66427.1 of the Subdivision Map Act are not applicable to a "buildings only" condominium conversion which does not involve displacement of tenants or the offering of dwelling units for sale to the public: (1) Notice of intention to convert prior to termination of tenancy, as set forth in subsection (c) of said section. (2) Notice of an exclusive right to contract for the purchase of a dwelling unit, as set forth in subsection (d) of said section. (g) The proposed subdivision and the provisions for its design and improvement are consistent with the general plan of the City of Santa Ana. The provisions of the Housing Element of the said general plan which pertain to condominium conversions apply only to the conversion of apartment units to condominiums. A "buildings only" condominium conversion is not within the scope of the limitations set forth therein. 2. Tentative Map No. 11921 is hereby approved, subject to the conditons set forth in the staff report on said project, RESOLUTION NO. 84-98 PAGE THREE dated April 18, 1984, on file in the office of the of Community Development and Housing.
