RESOLUTION NO. 86-_~
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA DENYING CONDITIONAL
USE PERMIT APPLICATION NO. 85-28 TO
ALLOW EXPANSION OF A MOTEL IN THE C2
DISTRICT AT 3225 WEST FIRST STREET
WHEREAS, the City Council held a public hearing on
January 6, 1986 on Conditional Use Permit No. 85-28 to allow
expansion of a motel in the C2 District on property located at
3225 West First Street, which application was brought before
this Council by Appeal No. 530 following its denial by the
Planning Commission;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA AS FOLLOWS:
1. Based on the evidence submitted at the abovesaid
hearing, this Council finds and determines as follows:
(a) The applicants propose the expansion of an
existing 16-unit motel. At present, the motel is
utilized not as a short term residential facility,
but has the character and tenant occupancy of apart-
ments. As such, the project does not comply with
Code requirements for this type of residential use.
Because the project does not function as a motel,
an expansion to create more units which do not con-
form to apartment standards or commercial motel
standards will not be an asset to the neighborhood.
(b) Expansion of the motel as it is currently
operated will, under the circumstances, be detri-
mental to the general welfare of persons residing
in the units because they are not being afforded
the full benefit of a standard residential unit.
(c) The proposed expansion will impact the
economic stability of the site and surrounding
properties by adding to a nonconforming use which
cannot meet Code requirements. The present oper-
ation is not well-maintained, does not meet Code
Standards and detracts from the appearance of the
First Street Corridor.

(d) The proposed expansion will not comply with
Code requirements without an approved variance to permit
a rear yard setback waiver and a waiver of a portion of
the required front yard landscaping. Any expansion of a
nonconforming use requires full compliance with all
current Code Standards.
(e) The requested expansion will have an adverse
effect upon the General Plan by increasing the viability
of a nonconforming use and substandard housing. The
City's goals and objectives for the First Street Cor-
ridor are to encourage quality developments that are
attractive and well designed. The motel proposed is
inconsistant with these goals.
2. Conditional Use Permit Application No. 85-28 is
hereby denied.
