RESOLUTION OF THE CITY COUNCIL FINDING THE
PREMISES LOCATED AT 221 $. BROADWAY STREET,
SANTA ANA, CALIFORNIA, TO CONSTITUTE A PUBLIC
NUISANCE AS DEFINED IN SANTA ANA MUNICIPAL
CODE AND AUTHORIZING ABATEMENT OF SAME.

WHEREAS, the City Council of the City of Santa Ana has
in Chapter 17 of the Santa Ana Municipal Code, for the
of a premise as a public nuisance;
WHEREAS, on December 30, 1985, Notice to Abate a Public
Nuisance was served pursuant to Section 17-5 of the Santa Ana
Municipal Code on the record owner, Mr. Leonard R. Bedale, of the
premises located at 221 S. Broadway Street, Santa Ana,
California;
WHEREAS, said owner after receiving notice failed to
file any objection to the determination that the premises located
at 221 South Broadway, Santa Ana, California, constituted a
public nuisance, within the meaning of Section 3479 of the
California Civil Code and as defined in Section 17-1 of the Santa
Ana Municipal Code;
WHEREAS, the conditions found by the Executive Director
of Community Development and Housing in the December 30, 1985
Notice to Abate Public Nuisance constitute a public nuisance
within the meaning of Section 3479 of the California Civil Code
and Section 17-1 of the Santa Ana Municipal Code in the following
particulars:
Premises consist of a vacant
uncompleted 17 unit apartment
structure, not constructed per
code with no work activity
within the preceeding six months.
WHEREAS, the manner of abatement of said public
nuisance located at 221 S. Broadway, Santa Ana, California, shall
be accomplished as prescribed in the December 30, 1985 Notice to
Abate a Public Nuisance by obtaining demolition permits and
demolishing structure within (30) thirty days.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SANTA ANA:
1. The premises located at 221 S. Broadway Street,
Santa Ana, California, and the conditions therein constitute a
public nuisance as defined in Section 3479 of the California
Civil Code;

2. The premises consist of vacant uncompleted 17 unit
apartment structure, not constructed per code with no work
activity within the preceeding six (6) months;
3. The owner, Mr. Leonard R. Bedale, shall have 30
days from receipt of service of this resolution or 60 days from
the date of adoption of same, whichever is earlier, to abate the
premises located at 221 S. Broadway, Santa Ana, by demolition;
4. In the event Mr. Leonard R. Bedale fails to abate
by demolition the premises located at 221 South Broadway, Santa
Ana, California, within the time period prescribed by this
resolution, the City Attorney is authorized to initiate legal
action to secure said abatement in the appropriate legal forum;
5. The Clerk of the Council is directed to serve a
copy of this resolution to the owner of record, Mr. Leonard R.
Bedale dba American Mortgage Company, 770 South Main Street,
Suite 150, Orange, California, by certified mail, return
receipt requested.
