A RESOLUTION OF THE CITY COUNCIL OF THE CITY
CITY OF SANTA ANA OVERULING OBJECTIONS AND
CONFIRMING A REPORT OF THE EXECUTIVE DIRECTOR
OF COMMUNITY DEVELOPMENT AND HOUSING AGENCY
PERTAINING TO THE COST EXPENDED FROM THE
SPECIAL REVOLVING FUND FOR REPAIR AND DEMOLITION
OF DANGEROUS BUILDINGS AS PROVIDED IN CHAPTER 8
OF THE SANTA ANA MUNICIPAL CODE; AND LEVYING
ASSESSMENTS TO REIMBURSE THE REPAIR AND
DEMOLITION FUND; AND ORDERING A COPY THEREOF
TO BE FILED WITH THE COUNTY AUDITOR, ASSESSOR,
AND TAX COLLECTOR.
WHEREAS, pursuant to Section 13-70 of the Santa Ana
Municipal Code there is established a special revolving fund
designated as the Repair and Demolition fund; and
WHEREAS, payments shall be made out of said fund upon
the demand of the City Manager to defray the cost and expenses
which may be incurred by the City in doing or causing the
repair or demolition of dangerous buildings as provided in
Chapter 8 of this code; and
WHEREAS, pursuant to Section 8-1900 of the Santa Ana
Municipal Code the Executive Director of the Community
Development and Housing Agency has submitted an itemized
account of expenses incurred in the repair or demolition of
dangerous buildings which is on file with the Clerk of the
Council showing the cost of repair or demolition including
the cost for securing vacant, abandoned structures on each
lot or parcel of real property as shown on said report; and
WHEREAS, the Executive Director of Community Develop-
ment and Housing Agency has given notice as required by law,
in which the 19th of August, 1985, at the hour of 7:30 p.m.,
was affixed as the time, and 22 Civic Center Plaza, Santa Ana,
as the place where any and all persons interested in said
report might be heard; and
WHEREAS, the City Council of the City of Santa Ana
at said time and place has received, heard,and considered
said report and all objections thereto submitted by property
owners liable to be assessed for the cost of repair and
demolition expended from the special fund and directed such
modification of said report as it has deemed necessary;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SANTA ANA:
1. Each and every objection to said work and cost
thereof is hereby OVERULED. Said report, a copy of which is
on file with the Clerk of the Council, is hereby confirmed;
the cost of repair and demolition work done upon each lot or
parcel of real property, as shown on said report, is hereby
made and confirmed as an assessment against such lots or
parcels, respectively; said assessments are hereby levied and
shall constitute liens on the respective lot or parcels of
real property shown on said report until paid.
2. The Executive Director of Community Development and
Housing Agency is hereby directed to file a certified copy of
said report and this resolution with the County Auditor, County
Tax Assessor, and County Tax Collector on or before August 19,
1985.
3. The County Auditor is requested to enter the
assessments on the County tax rolls.
4. The County Tax Collector is requested to collect
the assessments at the time and in the manner of ordinary
municipal taxes.
