HomeMy WebLinkAbout85-107REL: adg 8/22/85 RESOLUTION NO. 85-107 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING VARIANCE NO. 85-11 TO ALLOW AN OFF-PREMISE ADVERTISING SIGN ON PROPERTY LOCATED AT 2941 HESPERIAN STREET WHEREAS, this Council held a public hearing on August 19, 1985 on Variance Application No. 85-11, to allow an off-premise advertising sign at 2941 Hesperian Street at variance with the location, height and size restrictions of the zoning regulations; and WHEREAS, prior to taking action on the said applica- tions, this Council has reviewed and approved the negative declaration (I.S. No. 85-81) prepared for the project; NOW, THEREFORE~ BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing, this Council finds and determines as follows: (a) The strict application of the zoning ordinance's restrictions on height, size and location would deprive the subject property of privileges not otherwise at variance with the intent and purpose of the said ordin- ance, due to the special circumstances of the subject property's location and surroundings. (b) The approval of the subject variance is necessary to preserve the right of the owner of the subject property to preserve and enjoy a Substantial property right. (c) The subject sign will not have a significant adverse effect on persons or property in the vicinity, due to the circumstances of its location and surround- ings and the conditions of approval hereinbelow. ~ RESOLUTION NO. 85-107 PAGE TWO (d) As conditional hereinbelow, the subject sign will not have a significant adverse effect on the future development of the surrounding area in accordance with the General Plan of the City. 2. Variance 85-11 is hereby approved, subject to the following limitations, requirements, and conditions: (a) The sign shall not exceed 65 feet in height or 864 square feet in size. (b) The sign must comply with the design and structure shielding standards of the Municipal Code. (c) The sign structure must be architecturally treated to screen frame, poles, support structures and lighting from public view. This architectural treatment is subject to prior approval by the Planning Manager. (d) Ail areas containing outdoor storage must be screened by a 6-foot heigh solid wall or fence. (e) The sign shall be so located that no portion of it is over the Hesperian Street right-of-way. ADOPTED this l?th day of September , 1985.
