RESOLUTION NO. 85-108
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA DENYING CONDITIONAL
USE PERMIT APPLICATION NO. 85-27 TO
ALLOW A CHURCH IN THE R1 DISTRICT AT
5009 WEST FIFTH STREET
WHEREAS~ the City Council held a public hearing on
August 19, 1985 on Conditional Use Permit No. 85-27 to allow
a church in the R1 District on property located at 5009 West
Fifth Street, which application was brought before this Council
by Appeal No. 528 following its denial by the Planning Commis-
sion;
OF THE
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
CITY OF SANTA ANA AS FOLLOWS:
1. Based on the evidence submitted at the abovesaid
hearing, this Council finds and determines as follows:
(a} The proposed church will not contribute to
the general well being of this neighborhood because
the property and building were not designed to
accommodate the needs of a multi-purpose church
facility on a single-family residential size lot.
(b) The proposed use will be detrimental to the
health, safety and general welfare of persons residing
and working in this neighborhood by creating additional
parking problems on public streets, increasing noise
levels in this residential community, and increasing
traffic.
(c) The proposed use may affect the economic
stability of this residential neighborhood by nega-
tively impacting the surrounding residential property
owners with undue noise, parking intrusion and other
non-residential activity in the area.

2. Conditional Use Permit Application NO. 85-27 is
hereby denied.
