RESOLUTION NO. 85- 143
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA DENYING CONDITIONAL USE
PERMIT APPLICATION NO. 85-34 TO ALLOW THE
SALE OF ALCOHOLIC BEVERAGES IN A COMBINED
MARKET AND GAS STATION IN THE C1 DISTRICT
AT 1104 SOUTH BRISTOL STREET
WHEREAS, the City Council held a public hearing on
November 18, 1985 on Conditional Use Permit No. 85-34 to allow
the sale of alcoholic beverages in a combined market and gas
station in the C1 District on property located at 1104 South
Bristol Street, which application was brought before this
Council by Appeal No. 532 following its denial by the Planning
Commission;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid
hearing this Council finds and determines as follows:
(a) The proposed use will not enhance the individual
identity to this neighborhood or improve the quality of life,
public safety or general well being. There are presently 12
businesses licensed to sell alcoholic beverages within 1,000
feet of the subject property. Approval of the conditional use
permit request would result in an over-concentration of off-
sale establishments within the immediate area of the proposed
use.
(b) The proposed use will be detrimental to the health,
safety and general welfare of persons residing or working in the
vicinity in that the basic needs for off-sale of all types of
alcoholic beverages are served by a variety of existing markets
located in this area. The introduction of additional off-sale
establishments will not contribute to the general welfare of
persons residing in the immediate surrounding area.
(c) The proposed use will adversely affect the
stability of the area in that an over-concentration of businesses
selling alcoholic beverages does not afford the area an economic-
ally balanced retail climate needed to sustain this mixed commer-
cial area.

(d) The proposed Droject with the conditions of CUP
85-34 will comply with the regulations and conditions specified
in this chapter for such use. However, it does not provide any
special design or land use amenities that make it special or
warrant consideration as a special use.
(e) The Land Use Element designation for this area
is District Center. The proposed use will not upgrade the
economic vitality of an existing shopping center or support the
balancing of land uses and meet the basic needs of the community.
