HomeMy WebLinkAbout87-030 --153 CDG:mb 10-23-86 RESOLUTION 87-30 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA DELEGATING TO THE EXECUTIVE DIRECTOR OF THE RECREATION AND COMMUNITY SERVICES AGENCY THE AUTHORITY TO WAIVE FEES FOR THE USE OF PROPERTIES UNDER THE CONTROL OF THE RECREATION AND COMMUNITY SERVICES AGENCY. WHEREAS, The City of Santa Ana permits use of certain properties under the control of the Recreation and Community Services Agency for benefit of a limited number of persons when the cost of such use is borne by that limited group who are beneficiaries of such use; and WHEREAS, the City Council has established by resolution the fees for use of such properties; and WHEREAS, the City Council has the authority to waive fees, or to decline requests for fee waivers, for the use of such properties; and WHEREAS, the City Council, in the interest of a more rapid response time to such requests, desires to delegate its authority to waive fees, or to decline requests for fee waivers for the use of certain properties under the control of the Recreation and Community Services Agency to the Director of said Agency within certain specific guidelines; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA: 1. Authority is hereby delegated to the Director of the Recreation and Community Services Agency to waive fees or to decline requests for fee waivers for the use of properties under the control of the Recreation and Community Services Agency. 2. The following criteria are to be used by the Director in making his determination: (a) Priority shall be given to youth-serving organizations. (b) The requesting organization shall be nonprofit and community - service oriented. (c) A minimum of fifty-one percent (51%) of the : 154' RESOLUTION NO. 87-30 PAGE TWO active participants shall be residents of Santa Ana and rosters establishing such residency shall be required. (d) The organization shall be non-discriminatory except that age requirements may be necessary in certain organized sports activities and for certain senior citizen programs. 3. Fee waivers shall not be granted under the following circumstances: (a) To nonresident groups, or (b) For fund raising activities, or (c) If the activity proposed has a political or religious purpose. 4. The Director of Recreation and Cultural Services may seek counsel and advice of the Board of Recreation and Parks pursuant to § 908 of the Charter of the City of Santa Ana.
