HomeMy WebLinkAbout88-016 7 155 3/1,4/88 RESOLUTION NO. 88-~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING VARIANCE NO. 87-12 TO ALLOW A TIRE SALES FACILITY AT VARIANCE WITH CERTAIN DEVELOPMENT STANDARDS AT 3601 WEST FIRST STREET WHEREAS, this Council held a public hearing on March 7, 1988 on Variance Application No. 87-12 to permit the conversion of a cocktail lounge into a tire sales facility at variance with applicable minimum lot size and street frontage standards, mini- mum land-scaped yard standards, and standards regarding the orientation of service bays, on property located at 3601 West First Street in the C2 use district, which application came before this Council as appeal number 88-1 following its denial by the Planning Commission; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based on the evidence submitted at the abovesaid hearing, this Council finds and determines as follows: a. The proposed conversion of the existing vacant cocktail lounge building to a tire sales facility will be an improvement of the subject property and an enhancement of the surrounding neighborhood. b. Strict adhearance to the applicable lot size, street frontage, land-scaping, and service bay orientation standards would make the proposed project infeasible to carry out. c. Because of special circumstance applicable to the subject property, the strict application of the zoning ordinances would deprive the property of privileges not at variance with the intent and purpose of the zoning ordinances. d. The granting of this variance is necessary for the presentation and enjoyment of one or more substantial property rights. 156 RESOLUTION NO. 88- 16 PAGE TWO e. The granting of this variance will not be materi- ally detrimental to the public welfare or injurious to surround- ing property. f. The granting of this variance will not adversely affect the General Business District land use designation for the area established by the General Plan of the City. 2. Variance 87-12 is hereby approved subject to the con- ditions, limitations and requirements set forth in Exhibit A, attached hereto and incorporated herein by reference. Co~per City Att~y 15 7 CONDITIONS Should the Planning Commission recommend approval of Variance No. 87-12, the project lust comply with all applicable sections o£ the Santa Ana Municipal Code, the California Administrative Code, the Uni£orm Pire Code, the Uni£orm Building Code and other applicable regulations. In addition, it shall meet the following: A. PLANNING The parking spaces which require existing vehicles to back out onto the public alley shall be recon£igured so that all backing movements are accommodated on the project site. The use of the site shall be limited to a tire sales and service facility without any other automobile repair services provided. The operating hours o£ the £acility shall be no earlier than 8:00 a.m. and no later than 7:00 p.m. Monday through Saturday and no earlier than 9:00 a.m. or later than 5:00 p.m. on Sunday. B. PUBLIC WOR~S AOENCY The site plan property dimensions must be revised to re£1ect the 2.5' required alley dedication, the 2' required First Street dedication and the new 27' radius spandrel dedication. The site plan must be reviewed to show First Street to be 50' existing (52' proposed) street centerline to property line and show Gunther Drive to be $0' street centerline to property line. The site plan must be revised to indicate replacement of the three parking stalls at the rear of the building, with two parking stalls turned at a 90° angle with access £rom t~e aisle. EXHIBIT A
