HomeMy WebLinkAbout88-054 REL '.mb ( 14 ) 6/15/88 RESOLUTION NO. 88- 54 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA SETTING PARK ACQUISI- TION AND DEVELOPMENT FEES WHEREAS, sections 35-108 through 35-114 of the Santa Ana Municipal Code ("SAMC") establishes the authority for the City to establish fees on residential development to pay for the acquisition, construction, and renovation of park and recreation facilities; and WHEREAS, SAMC section 35-110 is being or has been amended to provide for the amount of said fees to be set by resolution of the City Council; and WHEREAS, the City Council does now find it necessary to increase such park acquisition and development fees; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Pursuant to SAMC section 35-110, any person adding net residential units shall pay a fee for each such residential unit based upon the number of bedrooms therein, in accordance with the following schedule: net Bedrooms Fee 5 or more $2,515.00 4 $2,270.00 3 $2,040.00 2 $1,530.00 1 or less $1,145.00 b. Any person converting apartments to condominiums shall pay a fee in an amount which is equivalent to the fee for such condominiums as net residential units, less an amount equal to the total fees paid under SAMC sections 35-108 through 35-114 for the same residential units at the time of construction as apartments. 2. In accordance with SAMC section 35-110, the pur- pose of the abovesaid fee is to preserve an appropriate balance between demand by residents for use of park and recreational facilities and the availability of such park and recreational facilities and to preclude residential development which would create an excess demand on such facilities. 3. In accordance with SAMC section 35-108, the use to which the abovesaid fee will be put is the acquisition, con- struction and renovation of park and recreation facilities. The public facilities to be financed by the fee are identified in Exhibit A, attached hereto and incorported herein. 350 RESOLUTION NO. 88-54 PAGE TWO 4. The fee appIies t6:r~sidential development. The use of the fee for park and recreation facilities is reasonably related to residential development because such facilities primarily benefit the residents of the City, rather than the owners and occupants of nonresidential property. 5. The need for the public facilities is reasonably related to residential development because it is the owners and occupants of residential property that create the demand for park and recreation facilities. 6. As used hereinafter "project" means proposed con- struction activity which is subject to the payment of a fee pur- suant to SAMC sections 35-108 through 35-114 and as to which construction pursuant to a validly issued building permit has not commenced as of the effective date of this resolution. 7. The fees established by this resolution shall apply to all projects except as otherwise hereinafter provided. 8. Any project for which a building permit has been issued prior to the effective date of this resolution shall be subject to the park acquisition and development fees formerly specified in SAMC section 35-110 (as amended by Ordinance No. NS-1923) unless such building permit expires without commence- ment of construction. 9. The effective date of this resolution is the later of the following: (i) the date of adoption of this resolution, or (ii) the effective date of an ordinance of the City which amends SAMC section 35-110 to provide that the amount of the fee therein referenced shall be set by resolution of the City Council.
