RESOLUTION NO. 88-55
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA APPROVING VARIANCE NO.
88-6 TO ALLOW FOUR WALL SIGNS IN EXCESS
OF SIZE LIMITATIONS ON ONE SIDE OF A
BUILDING LOCATED AT 305 EAST FOURTH STREET
WHEREAS, this Council held a public hearing on
July 5, 1988, on Variance application No. 88-6 to allow four
wall signs in excess of size limitations on one side of a
building located at 305 East Fourth Street;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA AS FOLLOWS:
1. Based on the evidence submitted at the abovesaid
hearing this Council finds and determines as follows:
(a) The building is a theater having a special
need for a marquee sign in addition to a theater name sign.
It is located in the Fiesta Marketplace theme development
and has special needs for additional identification signs
addressing pedestrian traffic on Fourth Street. Thus, the
str4et application of the zoning regulations would deprive
the subject property of privileges not otherwise at variance
with the purpose and intent of such regulations.
(b) The granting of this variance is necessary to
allow the subject property to operate effectively as a
theater, which is a substantial property right.
(c) The theater signage allowed by this variance
is compatible with the pedestrian marketplace theme of Fiesta
Marketplace and, therefore, will not be detrimental to the
public welfare or injurious to surrounding property.
