HomeMy WebLinkAbout88-066REL:mb(23) 9/9/88 RESOLUTION NO. 88- ~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING CONDITIONAL USE PERMIT NO. 88-11 TO ALLOW A CHURCH AT 4405 WEST EDINGER AVENUE WHEREAS, this Council held a public hearing on Sep- tember 6, 1988, on Conditional Use Permit Application No. 88-11, to allow a church at 4405 West Edinger Avenue in the R-1 district, on property designated in Exhibit A, attached hereto and incor- porated herein, said application having been brought before this Council by Appeal No. 88-3 following its approval by the Planning Commission; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing, this Council finds and determines as follows: (a) That the proposed use will provide a service or facility which will contribute to the general well being of the neighborhood or the community. The pro- posed church will provide an attractive, functional worship facility for members of the community. The facility also includes a library and social hall to further enhance the community services available at the site. (b) That the proposed use will not, under the cir- cumstances of the particular case, be detrimental to the health, safety, or general welfare of persons re- siding or working in the vicinity. The church and associated uses will provide a service to the com- munity and should not be detrimental to the health, safety or welfare of persons living or working in the area. (c) That the proposed use will not adversely affect the present economic stability or future economic development of property in the surrounding area. The proposed church facility is an attractive use for this area which includes a mixture of large single family residential properties and ancillary commercial uses. The proposed church should have no adverse impact on the economic stability or future economic development of the area. (d) That the proposed use will comply with the regu- lations and conditions specified in this chapter for such use. The church operation will comply with all the appropriate regulations of the Santa Ana Municipal Code and in addition to the specific conditions of this application. 4O5 406 RESOLUTION NO. 88- ~ PAGE TWO (e) That the proposed use will not adversely affect the General Plan of the City or any specific plan applicable to the area of the proposed use. The General Plan for this area is Low Density Residential which allows for residential-serving uses such as the proposed church. 2. EXHIBIT A ?. I II I 0 e 10. 11. 12. REL:mb(23) 409 EXHIBIT B CONDITIONS OF APPROVAL C.U.P. NO. 88-11 There shall be no simultaneous use of both the worship area and the social hall. A one-half hour time separation shall be required between the unrelated use of the two areas. This separation is to allow for the clearing of the parking lot between uses. A lot line adjustment shall be filed prior to Building Plan Check to facilitate the consolidation of the project site into one lot. The church operating hours shall be limited to 7~00 a.m. to 10:00 p.m. for all activities, except that the church may remain open until 12:00 midnight on the following Coptic Church holidays: New Years Eve, Easter Eve, Epiphany and Christmas (celebrated on January 6). This conditional use permit shall be subject to be reviewed every six months by the Planning staff. The social hall shall be utilized for church related functions only and subject to the operating hours listed in condition number three. A six-foot wall shall be constructed between the parcels fac- inG on Regent Drive and the main church facility. A six-foot wall shall be constructed along the property lines abutting the residential parcels prior to the commencement of demolition of the existing structures or other construction activity. A lot line adjustment creating one parcel for the project shall be filed with the PlanninG Director prior to the issuance of building permits. The residential structures fronting on Regent Drive shall be used only for residential purposes (including use as a guesthouse). The grantee shall construct a new full width (8-foot) sidewalk along Edinger Avenue. The grantee shall establish a "No Stopping Anytime" zone on Edinger Avenue as approved by the Public Works Agency staff. The grantee shall construct a raised median and striping street improvement plan for Edinger Avenue from the east side of Newhope Street across subject property frontage. (Note: Median plan to be approved by the City of Fountain Valley Public Works Agency.) -1- 410 13. The grantee shall install a "Right Turn Only" sign at the church driveway on Edinger Avenue. 14. The grantee shall close the drive approaches on Regent Drive serving the existing garages which are to be removed. 15. The grantee shall construct one new drive approach on Regent Drive per the approved Improvement Plan to serve the new garage structure. -2-
