HomeMy WebLinkAbout89-009BOO~A~ ):0:~ 11/8/88 DEED t:9.~ ~4R~' .- Rev. 12/1/88 ~:~ Rev. 1/10/89 RESOLUTION NO. 89-9 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA VACATING OLIVE STREET BETWEEN THIRD STREET AND SANTA ANA BOULEVARD AND AN EAST-WEST ALLEY TO THE WEST THEREOF. WHEREAS, this Council heretofore adopted on December 19, 1988, Resolution No. 88-85, wherein it declared its intention to vacate, pursuant to and in accordance with the provisions of Chapter 3 of Part 3 of Division 9 of the Streets and Highways Code of the State of California, Olive Street between Third Street and Santa Ana Boulevard and an east-west alley to the west thereof. WHEREAS, said Resolution gave notice that on Janu- ary 3, 1989, at 7:00 P.M., or as soon thereafter as the matter could be heard, in the Council Chambers of the City of Santa Ana, 20 Civic Center Plaza, Santa Ana, California, this Council would hear any and all persons interested in or object- ing to said proposed vacation of the said street portion; and WHEREAS, on January 3, 1989, at the time and place set for said hearing, said hearing was continued to January 17 at the same time and place; and WHEREAS, this Council finds that said Resolution has been published in the manner prescribed by law for the publish- ing of ordinances of the City; and WHEREAS, this Council further finds that notices of said proposed street and alley vacation stating the purposes of said Resolution and the time and place set for hearing were posted as directed by the Council and required by law; and ' 034 RESOLUTION NO. 89-9 PAGE TWO WHEREAS, this Council at the time and place set for hearing heard any and all persons interested in or objecting to said proposed vacation of said street and alley, and received and considered all evidence submitted; WHEREAS, this Council finds from all the evidence submitted that the said street and alley described in "Exhibit A" attached hereto, is unnecessary for present or prospective public use, based upon the following findings of fact: 1. Said street and alley are not necessary to provide access to abutting property owners. 2. Said street and alley are not necessary or convenient for servicing the flow of traffic. WHEREAS, pursuant to the provisions of ~ 2381 of the Streets and Highway Code of the State of California, the City Council does hereby find and determine that neither said street or alley nor part thereof, is useful as a nonmotorized transportation facility, as defined in ~ 156 of said Code; and WHEREAS, pursuant to the provisions of ~ 8340(c) of the said Streets and Highways Code, the City Council does hereby find and determine that there are not any in-place utility facilities that are in use in said street portion. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. That this Council does hereby order that Olive Street between Third Street and Santa Ana Boulevard and an east-west alley to the west thereof, described in "Exhibit A" attached hereto and made a part hereof by this reference, be, and the same is, hereby vacated. 2. The Clerk of the Council is hereby directed to cause a certified copy hereof, attested by her under seal, to 035 RESOLUTION NO. 8'9- 9 PAGE THREE be recorded forthwith in the office of the Recorder of Orange County. C~_~pe r City At tor ~y A-13 SITE ABANDONMENT LECAL DESCItXPTXON That certain portion of Olive Street, 40.0 feet wide, in the State of California, County of Orange, City of Santa Ama, as shown on that certain corrected map of the Ross Addition to Santa Ama recorded in Book 3, page 534 of Miscellaneous Records of Los Angeles County, California, bounded Southerly by the Westerly prolongation of the South line of Block N of said Ross Addition, and bounded Northerly by the Westerly prolongation of a line parallel with and distant Southerly 12.0 feet from the North line of said Block N; Together with that certain 20.0 foot wide alley as shown on an unrecorded map of Dawson Addition, disclosed in Book 60, page 25 of Don Hillyard's field notes on file in the Office of the County Surveyor of said Orange County, bounded Easterly by the West line of said Olive Street, and bounded Westerly by a line parallel with and distant Westerly 280.0 feet from said West line of Olive Street, the North line of said alley being parallel with and distant Southerly 115.0 feet from the Westerly prolongation of the North line of said Block N of the Ross Addition.
