RESOLUTION NO. 89- ~2
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA ANA APPROVING CON-
DITIONAL USE PERMIT NO. 88-5 TO ALLOW
SALE OF BEER AND WINE FOR OFF-SITE
CONSUMPTION AT A GROCERY STORE LOCATED
AT 1900 SOUTH MAIN STREET.
WHEREAS, Conditional Use Permit Application No. 88-5,
to allow sale of beer and wine for off-site consumption at a
grocery store located at 1900 South Main Street, was denied by
the Planning Commission on January 23, 1989; and
WHEREAS, on February 6, 1989 the City Council set
Conditional Use Permit Application No. 88-5 for public hearing
pursuant to section 41-645.5(b) of the Santa Ana Municipal Code,
thereby vacating the decision of the Planning Commission; and
WHEREAS, on March 20, 1989 the City Council held a
public hearing on Conditional Use Permit Application No. 88-5;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SANTA ANA AS FOLLOWS:
1. Based on the evidence submitted at the abovesaid hear-
ing, the City Council finds and determines as follows:
(a)
The sale of beer and wine in the grocery store
on the subject property incidental to general
food sales will be a convenience to neighborhood
shoppers.
(b)
The sale of beer and wine at the grocery store
will be limited to a small portion of total sales.
Therefore, it will not be a blighting influence
on the area in which it is located.
(c)
For the foregoing reasons, the sale of beer and
wine at the grocery store on the subject property
provides a service which contributes to the
general well-being of the neighborhood.
(d)
Under the foregoing circumstances, such use will
not be detrimental to the health, safety, or general
welfare of persons residing or working in the
vicinity.
(e)
Such use will not adversely affect the present
economic stability or future economic development
of property in the surrounding area.

(f)
By the granting of this Conditional Use Permit,
such use will comply with the regulations and
conditions specified for it in the zoning chapter
of the Municipal Code.
(g) Such use is consistent with the City's General
Plan.
2. Conditional Use Permit NO. 88-5, allowing the sale
of beer and wine for off-site consumption in a grocery store
located at 1900 South Main Street, is hereby approved subject
to the following conditions:
(a) There shall be no banner or signage advertising
the sale of beer or wine.
(b)
No more than 10 percent of the floor area shall
be devoted to the sale, display and storage of
alcoholic beverages.
(c) The cash register shall be visible from the street.
(d) Window displays shall be kept to a minimum for
maximum visibility.
(e) Window displays and racks shall be kept to a maxi-
mum height of three feet including merchandise.
(f) A timed access cash controller shall be installed.
(g) Interior displays and racks shall be kept to a
maximum of five feet including merchandise.
(h) A silent armed robbery alarm shall be installed.
The subject building shall be upgraded by the
addition of awnings and canopies and the repair
of the large sign.
(j) A large light standard to light up the parking
lot shall be installed.
(k) The exterior of the subject building shall be
repainted by the end of 1990.

3. Conditional Use Permit No. 88-5 shall be reviewed by
the Planning Commission in 1990 and 1991 to determine whether
there has been compliance with conditions hereinabove set forth.
