A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA ANA ESTAB-
LISHING TRANSPORTATION SYSTEM IM-
PROVEMENT PROGRAM AREA A-1 AND
SETTING DEVELOPMENT FEES THEREFOR.
WHEREAS, section 8-44 of the Santa Ana Municipal Code
("SAMC") establishes the authority for the City Council to create
Transportation System Improvement Program ("TSIP") Areas and to
establish fees on development in such areas to pay for transporta-
tion system improvements located in or benefitting such areas; and
WHEREAS, the City Council by previously adopted resolu-
tions, has established TSIP Areas A through F in the City of
Santa Aha; and
WHEREAS, the City of Santa Ana has entered into a joint
powers agreement with the City of Orange to form a joint powers
agency entitled the "Transportation System Improvement Authority"
to administer the expenditure of transportation system improvement
fees collected from a "TSIP Area," consisting of a portion of
TSIP Area A in the City of Santa Ana and a similar specified area
of the City of Orange, for the benefit of said TSIP Area as a
whole; and
WHEREAS, that portion of TSIP Area A which is included
within the jurisdiction of the Transportation System Improvement
Authority is identified in Exhibit A, attached hereto and incor-
porated herein, and is hereinafter referred to as "Area A-l;" and
WHEREAS, the said Transportation System Improvement
Authority has determined that, in order to obtain sufficient funds
for the construction of adequate transportation system improve-
ments located within or benefitting the TSIP Area, development fees
for transportation system improvements need to be increased to
a level of $4.55 per square foot of development throughout the
TSIP Area; and
WHEREAS, included within Area A-1 is that certain pro-
perty (hereinafter referred to as the "Mainplace Site") which
is the subject of a Participation Agreement, dated May 15, 1984,
between the Community Redevelopment Agency of the City of Santa
Ana ("Agency") and Santa Ana Venture ("Venture"), and which is
specifically described therein; and
WHEREAS, in conjunction with the development of the
Mainplace Site, Agency and Venture have expended funds in excess
of the transportation improvement system development fee for
transportation system improvements benefitting the TSIP Area to
the extent that it is fair and reasonable to allow further develop-

ment of the Mainplace site at the current fee of one percent of
estimated cost of development;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SANTA ANA AS FOLLOWS:
1. TSIP Area A-i, as identified in Exhibit A, is hereby
established as a separate and distinct transportation system
improvement program area.
2. Except as otherwise provided hereinbelow, the fee
charged pursuant to SAMC section 8-44 for TSIP Area A-1 shall be
$4.55 per square foot of floor space in the construction or
improvement which is the subject of a building permit application
for which payment of a fee is required by said section 8-44.
3. The purpose of the abovesaid fee is set forth in sub-
section (e) of SAMC section 8-44 as follows:
"The purpose of a transportation system improve-
ment program is to identify and designate those areas
where the transportation system may experience a sig-
nificant reduction in the level of service unless
corrective measures are instituted concurrent with
increased transportation demands. Fees collected for
building projects and improvements on properties in a
transportation systems improvement program area shall
be used to improve the transportation system within
such area when such improvements will substantially
benefit the transportation system within the area."
4. The use to which the abovesaid fee will be put
is set forth in SAMC section 13-112 as follows:
"Monies in a transportation system improvement
program area fund shall be expended to improve the
transportation system within the area for which such
fund was established, or outside such area only when
such improvement will substantially benefit such area."
The public facilities to be financed by the fee are identified
in Exhibit B, attached hereto and incorporated herein.
5. The fee applies to all types of development projects,
including residential, commercial, office and industrial;
subject to certain limited exceptions set forth in section 9-44.
The use of the fee for transportation system improvements is
reasonably related to all types of development projects because

the owners, occupants and visitors of all types of uses are
benefitted by improved vehicular traffic flow.
6. The need for the public facilities is reasonably re-
lated to all types of development projects because all types
of development projects generate vehicular traffic. The restric-
tion of the use of fees to transportation system improvements
which are located in, or which substantially benefit, the area
of the City from which the fees are derived assures that the
fees derived from any given development project are used to pro-
vide those transportation improvements which most directly address
the needs created by such development project.
7. As used herein, "project" means any proposed construc-
tion which is subject to the payment of a fee pursuant to SAMC
section 8-44, and "one percent fee" means the fee which applied
to all development in Area A prior to this Resolution in an
amount equal to one percent (1%) of the estimated cost of con-
struction or improvement of a project. The fees established by
this resolution shall apply to all projects except as follows:
(a) Any project for which a building permit has been
issued prior to the date of this resolution shall be subject
to the one percent fee, unless such building permit expires
without commencement of construction.
(b) Any project on the Mainplace Site shall be subject
to the one percent fee.
