HomeMy WebLinkAbout90-004RESOLUTION NO. 90- 004 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AMENDING THE LAND USE ELEMENT OF THE GENERAL PLAN OF THE CITY OF SANTA ANA (GPA 89-9) REL:mb(24a) 1/03/90 Rev.1/9/90 WHEREAS, the Planning Commission of the City of Santa Ana, after duly noticed public hearing, approved an amendment to the General Plan of the City of Santa Ana as hereinafter set forth; and WHEREAS, this Council has reviewed and considered the initial environmental study and negative declaration prepared for such proposed General Plan amendment; and WHEREAS, this Council, after duly noticed public hear- ing, concurs in the Planning Commission's approval of said General Plan amendment; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. The adoption of the said General Plan amendment will not have a significant effect on the environment, and the negative declaration prepared for said amendment is hereby approved. 2. Exhibits 1 through 17, attached hereto, are hereby incorporated herein by reference, and referred to collectively hereinafter as "the Exhibits." 3. The "Land Use Plan" of the Land Use Element of the General Plan of the City of Santa Ana is hereby amended in the following particulars: a. The following areas delineated in the Exhibits are redesignated from their current land use categories to the "Low Density Residential" category: Exhibit 1, areas A and B Exhibit 2, areas A and B Exhibit 3 Exhibit 4 Exhibit 8 Exhibit 9 Exhibit 10 Exhibit 12, areas A, B, D and E Exhibit 13 Exhibit 14, areas A and B Exhibit 16, areas A and C Exhibit 17 RESOLUTION NO. 90-004 PAGE TWO b. The following areas delineated in the Exhibits are redesignated from the current land use categories to the "Medium Density Residential" category: Exhibit 5, areas A and B Exhibit 6 Exhibit 7, areas A and C Exhibit 11, areas A, B and D Exhibit 12, area C c. The residential density being in the "Mixed Use" category the following maximums: in those areas designated as in the Exhibits is reduced to (1) 15 dwelling units per acre: Exhibit 7, area B Exhibit 11, area C (2) 7 dwelling units per acre: Exhibit 15, areas A and B Exhibit 16, area B 4. Except as otherwise provided in paragraph 5 herein- below, any real property which on or before January 8, 1990 meets either or both of the following conditions may be developed in accordance with the density limitations of the General Plan as it existed immediately prior to its amendment by this Resolution: (a) Multiple-family residential development has been approved for the property through any one of the following discretionary actions: (1) Approval of a conditional use permit. (2) Approval of a tentative subdivision map. (3) Approval of a development project plan (commonly referred to as a "site plan") for the property pursuant to sections 41-688 et seq. of the Santa Ana Municipal Code, or, as to property in an SD (Specific Development) district, pursuant to the pro- cedures set forth in the applicable specific development plan. (b) Application for a building permit for such develop- ment has been filed pursuant to Chapter 3 of the Building Code. 229 RESOLUTION NO. 90-004 PAGE THREE 5. Any property which qualifies for development in accor- dance with the General Plan density limitations as they existed immediately prior to this General Plan Amendment pursuant to section 4 hereinabove, shall lose such qualification, and there- after be subject to the General Plan density limitations estab- lished by this General Plan Amendment, in the following circum- stances: (a) Where such qualification is based upon approval of a conditional use permit: if such conditional use permit is revoked for good cause or expires due to nonuse. (b) Where such qualification is based upon approval of a tentative map: if such tentative map expires without approval of a final map or parcel map. (c) Where such qualification is based upon development pro- ject plan ("site plan") approval: if application for a building permit for such development pursuant to Chapter 3 of the Building Code is not filed within one (1) year after the date of this resolution. (d) Where such qualification is based upon the filing of an application for a building permit pursuant to Chapter 3 of the Building Code: if such building permit application expires without issuance of the building permit, or, as to any development for which a building permit is issued, if such building permit expires without the commencement of construction pursuant thereto.
