RESOLUTION NO. 90-015
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA ANA SUMMARILY VACATING
AN UNUSED PORTION OF RIGHT-OF-WAY LOCATED
AT 1021 WEST SECOND STREET
WHEREAS, this Council finds and determines that a
certain portion of Second Street, more particularly described
in Exhibit A, attached hereto and incorporated herein, has
always been impassable for vehicular travel for a period exceed-
ing five consecutive years and that no public money has been
expended for maintenance on such street portion during such
period; and
WHEREAS, pursuant to the provisions of ~ 2381 of the
Streets and Highways Code of the State of California, this
Council does find and determine that the abovesaid street
portion is not useful as a nonmotorized transportation facility,
as defined in ~ 156 of said Code; and
WEEREAS, this Council finds and determines that there
are no in-place public utility facilites in theabovesaid street
portion; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SANTA ANA AS FOLLOWS:
1. Pursuant to the provisions of Chapter 4 of Part
33 of Division 9 of the Streets and Highways Code of the State
of California, and, in particular, Section 8334 thereof, that
portion of Second Street in the City of Santa Ana, County of
Orange, State of California, specifically described in Exhibit
A, attached hereto and incorporated herein by reference, is,
under the facts hereinabove recited, hereby vacated, and from
the date this resolution is recorded in the office of the
Recorder of Orange County, shall no longer constitute a street
or any portion thereof.

2. The Clerk of the Council is hereby directed to
cause a certified copy hereof, attested by her under seal, to
be recorded forthwith in the office of the Recorder of Orange
County.

All that certain real property situated in the State of California,
County of OranEe, City of Santa Ana, described as follows:
The South 5.0 feet of the East 40.0 feet of Lot 11 in Block A of
Nutchin's Subdivision as shown on that certain map recorded in Book 1,
page 52 of Miscellaneous Maps of said Orange County.
