motion of Councilman Hubbard, seconded by Brewer and carried.

On motion of Councilman Hubbard, seconded by Brewer and carried, the lowest and best
bid of American Asphalt Paving Company was accepted, in the total amount of
$8,669.00, and all other bids rejected.
This being the date set for hearing on proposed amendments to The Zoning Ordinance
of 1960; no protests were received and the hearing was closed. On motion Of Coun-
cilman Hubbard, seconded by Schlueter and carried, the following Ordinance entitled~
"Ordinance amending, adding or repealing portions of Parts l,
3, 4, 5 & 6 of Chapter 2, Article IX of the Santa Ana
Municipal Code dealing with land use regulations"
was introduced, considered and placed on file for second reading.
This being the date set for hearin~ on the annexation of property consisting of
9.97 acres, located at the southeast corner of Edinger Averme and Raitt Street; the
Mayor asked the Assistant Clerk of the Council if she had received any written pro-
tests, and s h e replied no written protests had been received. The Mayor asked if
any one present desired to be heard in said matter. No one present desired to be
heard, and the hearing was closed. On motion of CounciLman Hubbard, seconded by
Brewer and carried, the following Ordinance entitled:
"Ordinance declaring the annexation of territory designated
' Edinger and Raitt S. E. Annex '"
was introduced, considered and placed on file for second reading.
Cumm~nication was presented fram Charles Schneider, Realtor, stating he is owner
of three parcels in the area to be annexed (13542 through 13572 Edinger Avenue),
and requesting that an east-west street (Pomona) be proposed at the south end of
this property, thereby allowing for the development of the rear of these parcels.
On motion of Councilman Hubbard, seconded by Brewer and carried, the communication
was received and filed.
This being the date set for hearing to vacate a portion of Fairview Street north of
McFadden Avenue; no protests were received and the hearing was closed. The Council
having unanimously waived the reading of th~ Resolution, on motion of Councilman
Hubbard, seconded by Schlueter and carried, the following Resolution entitled:
"Resolution No. 61-136 ordering vacation of a portion of
Fairview Street north of McFadden Avenue"
was considered and passed by the following vote:

On motion of Councilman Hubbard, seconded by Brewer and carried, the communication
fram the planning Commission was received and filed, recc~mnending approval of pro-
posed annexation to the City of territory designated "Grand Avenue West and Santa
Clara Northeast Annex," consisting of approximately 10.10 acres, located on the
north side of Santa Clara Avenue, between East and West Grand Agenues.

Appeal Application No. 22 of Goodwill Industries was presented on Conditional Use
Permit No. 43, to erect an unenclosed roof structure for retail sales of products,
on property approximately 144 feet by 200 feet, located 620 feet south of the south-
west corner of Fifth and Fairview Streets, in the M-1 District. Applicant appealed
the Zoning Administrator's denial, stating the proposed use is not comparable with
any other use in the community, is of c~.~nity-wide benefit, and there were no
protests to the use. Attorney Walter H. Steiner, First Western Bank Building, re-
presenting the applicant, stated through an oversight his client was not present
at the hearing of the Zoning Administrator, where all aspects of the proposed use
of the property could have been discussed, and, in his opinion, satisfactorily re-
solved. On motion of CounciLman Hubbard, seconded by Schlueter aud carried, actio~
was continued to the next meeting.
Appeal Applicaticm No. 23 of Harold L. Wilson, 1223 West Myrtle Street, was presen-
ted on Variance Application No. 1481, to build a 24-unit apartment house on property
approximately 102 feet by 300 feet, located 140 feet north of the northwest corner
of Cubbon and Shelton Streets, in the R-1 District. Applicant appeals the denial
of the Zoning Administrator, because it may affect the opening of a short street
north of said property, and stated the size of the lot is too great for a single-
family residence~ which is bounded on the north and west by M-1 and R-3 uses.
Attorney Charles D. Lusin, ll80 No. Los Angeles Street, Anaheim, representing an
intended buyer of the propert% stated the best development of said property would
be for R-3 use, and his client would propose to construct 24 units, having 20 single
and four double units. Further, an attempt had been made to purchase the parcel
to the north to facilitate the extension of Brook Street east to Shelton Street,
but the owner was not willing to sell, and it would not be feasible for his client
to make any ccmmaitments or dedications for the opening of a street north of this

and carried, the comm~uication was received and filed. Mrs. Frances Britt, 1029
W. Cubbon Street and Mrs. V i Vi an B. Gobel, lO30 W. Brook Street, objected to the
stated
inadequate parking for the proposed proJect,an~bsarea would be too hazardous for
the children of the additional families due to the increased traffic. Clarence H.
Minery, 1002 So. Shelton Street, presented a petition with approximately 62 signa-
tures in protest of the proposed construction, and on motion of Councilman Brewer,
seconded by Hubbard and carried, the petition was received and filed. Harold L.
Wilson, 1123 W. Myrtle Street, presented a petition with 26 signatures favoring the
apartment house development, and on motion of CounciLman Hubbard, seconded by
Schlueter and carried, the petition was received and filed. On motion of CounciLman
Hubbard, seccaded by Brewer and carried, Appeal Application No. 23, filed by Harold
L. Wilson, was denied, the recommendation of the Zoning Administrator approved, and
Variance Application No. 1481 denied.
Appeal Application No. 24, filed by the Department of Public Works, appealing
Planning C~m~ission's deletion from their reco~m~endations of items b, d, e, f and
g, as defined by the Department of Public Works' recommendations on Conditional Use
Permit No. 40, filed by the Roman Catholic Archbishop ~f Los Angeles, to add one

pertaining to deeds and engineering by the City and the moving o~/~ence on Bristol
Street at City's expense. Mr. H. H. Foreman, Director, Department of Public Works~
recc~mnended that the following conditions be the responsibility of the Church:
(1) The dedication of an additional five feet along the frontage of their property
on Bristol Street; (2) That a curb, gutter and sidewalk be placed to the edge of
the existing pavement on Bristol Street; and (3) The dedication of all access righ~is
fron the property with exception of the existing driveways. Also, the condition
imposed by the Planning Department for the relocation of the fence. Attorney Mary
Waters, 727 W. Seventh Street, Los Angeles, representing the Rc~an Catholic Arch-
bishop of Los Angeles, stated her client was desirous of providing a classroom
only, comprising 1, O00 square feet, to be used for reading, and at the time the
building was constructed, a ten-foot strip along thirteen feet of property was
dedicated, with no reference to the street improvement along the Bristol Street side.
On motion of Councilman Hubbard, seconded by Schlueter and carried, Appeal Appli-
cation No. 24 of the Department of Public Works was denied, and the action of the
Planning Cc~mission upheld, approving Conditional Use permit No. 40, filed by the i
Rc~an Catholic Archbishop ~f Los Augeles, subject to conditions. )
On motion of Counciim~ Hubbard, seconded by Brewer and carried, the following Pre~'
liminary Record of Survey Map and Tentat iv e Tract Maps were approved:
Preliminary Record of Survey Map No. 207, filed by Chip Development Corpora-
tion, creating three lots located 660 feet south of Edinger Avenue and 1400 feet
west of Bristol Street, subject to conditions;
Tentative Tract Map No. 4226, filed by Mark Andrews, creating approximately
llO lots and located south of Santiago Creek and east of Santiago Avenue, subject
to conditions;
Tentative Tract Map No. 4227, filed by Boyle Engineering for the Montg~nery
Park Development Company, creating 176 lots located 600 feet south of Sugar Avenue
and east of Harbor Boulevard, subject to conditions; and
Second Revised Tentative Tract Map No. 4040, filed by Practical Builders, Inc~

On motion of Councilman Hubbard, seconded by Brewer and carried, Map of Tract No.
4024, filed by Sol,non Enterprises, Inc., for the dedication as public highways
Sugar Avenue, Tampion Avenue, Davit Avenue, Cooper Street, Deming Street and M~xine~
Street, and the dedication of easements for s~itary sewer purposes and the ease-
ments for drainage purposes so designated on said map, and all vehicular access
rights to Sugar Avenue, except at street intersection; and bond in the sum of
$110, O00.OO were approved; license fee in the sum of $~850.OO accepted~ and agree~
ment covering improvements ordered signed.
The Mayor announced that no action will be taken relative to the closing of the
Hoover or Wilson Schools Library Stations, for at least sixty days, pending a stud~
of the long-range program in this regard. The Manager, at the request of the
orally presented a report stating the reasons for his recommendation, and advised
the report would be recast for distribution to the City Council and other interested
groups. Attorney Walter H. Steiner, First Western Bank Building, representing the
parents of the Hoover and Wilson Schools, expressed appreciation for the extension
of time, and suggested the appointment of a eo~ittee to assist in the study. The
Mayor requested the appointment of two representatives each from the Board of Edu-
cation, Library Board, Santa Ana P.T.A. Council, Civic Affairs Committee of the
Chamber of Commerce, Junior Chamber of Co~mnerce~ Friends of the Library, Parents'

~.ibrary Conmaittee, and two members to be appointed by Councilmen Royal E. Hubbard
and Bob Brewer~ to fo~ra a Special ~"~ct-F~uding Comaittee to investigate the prohlealS
of the City Library in connection with branch libraries at schools. The Library
Board President, Arthur M. Bradley, c~.-~ended the City's library operation and wel-
corned the proposed study by representative groups. On motion of CounciLman Hubbard~
seconded by Schlueter and carried, Council was authorized to have the various
agencies appoint members to a study comittee to report back to the Council with
recommendations, within sixty days, and the City Manager be instructed not to close
the Wilson and Hoover Schools Library Stations within that period.

was authorized to execute Cost Service Contract with the California State Per-
sonnel Board, for examining services during the fiscal year 1961-62.
No action was taken in the matter of the Agreement with the County for a term of
one year, commencing July l, 1961, for the care of City prisoners in the County
jail, at the rate of $3.50 for the first 24 hours of confinementor fraction thereof,
and $2.20 for each 24-hour period or fraction thereof, thereafter.

purpose expressed in Article II of the Master Agreement
with the State of California Division of Highways"
for the fiscal year 1961-62, said sum to be budgeted for work to be done by the
City engineering staff in the Department of Public Works, was considered and passed

The Manager orally submitted his recommendation as to the City's policy in regard
to hanging overhead street banners, reference the request of the Secretary-Manager,
Orange County Fair, to hang seventeen overhead flag lines at various locations within
the City, to publicize the 1961 Orange County Fair, to be held July ll through 16,
said lines to be installed between June 28 and July l, and removed not later than
July 19, with one locatic~ on Main Street which will require a major street encroach-

ment permit from the/Division of Highways. On motion of Councilman Hubbard, seconded
by Brewer and carried, the recommendation of the Manager was approved, and the re-

quest of the Orange County Fair granted, to hang the overhead flag lines, to/include
the Christmas decorations. L. Gene Proffitt, 519 W. Fourth Street, representing
the Junior Chamber of Conmmerce, favored the flag displays.
On motion of Councilman Hubbard, seconded by Brewer and carried, the request of
W. Stanley Musfelt~ M.D., 1007 North Broadway, was denied, for a crosswalk across
Broadway at the north side of loth Street.
On motion of Councilman Hubbard, seconded by Brewer and carried, the request of the
Tustin Union High School was denied, for a pedestrian crosswalk across Seventeenth
Street at Mabury Street.
