A RESOLUTION OF THE CITY (I)UNCIL OF THE CITY OF SANTA ANA
AM~ik~IN~ THE BASIC (]OMP~SATION PLAN FOR CLASSES OF
MMPLOY~k~f D~SIGNAT~D AS UNAFFILIATED ~Ob~IDENTIAL CLASSES
WHEREAS, Section 1004, Article X of the City Ch~rter of the City
of Santa Ana requires the City Manager to prepare, install and maintain a
position classification and pay plan subject to civil service rules and
regulations and the approval of the city ODuncil; and
WHEREAS, on August 2, 1982, the city Council passed and adopted
Resolution No. 82-110 revising and re-establishing the basic
Classification and Compensation plan for the officers and Employees of
the City of Santa Aha; and
WHEREAS, on September 5, 1989, the City Council passed and
adopted Resolution No. 89-088 amending said Basic Classification and
O~mpensation Plan to designate certain classes of employment as
Unaffiliated Confidential (UC) and to provide such classes with certain
employee benefits or benefit levels not provided to non-management
classes represented by the several formally recognized amployee
associations; and
WHEREAS, an existing labor agreement between the City and the
Santa Ana City Employees ' Association/Service Employees International
Union, Local 1939, AFL-CIO, CLC, which represents approximately fifty
percent (50%) of all represented employees of the city, provides a Fiscal
year 1990-91 salary increase of 4.0%, effective July 1, 1990; and
WHEREAS, it is now desired to:
1. adjust the base salaries for unaffiliated Confidential
personnel for Fiscal year 1990-91 by the same percentage and in the same
manner as provided said represented employees by providing a four percent
(4.0%) across-the-board salary increase, effective July 1, 1990; and
2. add one existing class of employment to the list of
Unaffiliated Confidential classes.
NOW, THER]~RE, BE IT RESOLVED BY THE CITY ODUNCIL OF THE CITY
OF SANTA ANA: that Section 3 of Resolution No. 82-110, as amended, is
hereby further amended by:
1. Designating the existing class of Personnel Services
Receptionist as being an Unaffiliated Confidential class of employment by
assigning the parenthetical identifier "(UC)" next to the class title to
signify said designation.

2. Assigning the following classes to the salary rate ranges on
the effective dates as next hereinafter set out:

BE IT FUKTHER RESOLVI~: That Section 12 of Resolution No. 82-110
is hereby amended to read as follows:
Section 12. Employee Benefits for Confidential Employees.
Each employee in a class of employment designated in Section 3 of this
Resolution as Unaffiliated Corlfidential (UC), shall continue to receive
as additional cc~pensation, any and all employee benefits provided to
nc~-management, general service employees on or after July 1, 1989,
except as modified below:
A. Deferred Cc~pensation. Each Confidential employee
shall be eligible to receive as deferred cc~pensation an amount equal to
one percent (1.0%) of his or her monthly salary rate. The amounts
contributed by the city under this provision shall be subject to the
general terms and conditions of the City of Santa Ana Deferred
Ccmpensation plan, and subject, further, to the conditions that the
employee shall have no vested rights in the amounts contributed by the
City until termination of employment with the city and that the city will
pay the total amount of contributions plus any earnings to the employee
upon termination, resignation, retirement, dismissal or death.

B. Disability Insurance. The City shall continue to pay
one hundred percent (100%) of the premiun cost for coverage under the
same long-term disability insurance plan it maintains for management
officers and employees of the City.
C. Health and Dental Insurance. The City shall contribute
the following amounts toward the payment of premiums for affected
employees and their eligible dependents under the existing health and
dental insurance programs (or new programs providing substantially
similar coverage and benefits).
1. With respect to employees who do not have
dependents included under the programs, an amount equal to the highest
amount of City contribution applicable to the "employc~only" health and
dental coverages for employees as specified in any current operative
Memorandum of Understanding between the City and a recognized employee
organizat ion.
2. Wi th respect to employees who have dependents
included under the programs, an amount equal to the highest amount of
City cc~tribution applicable to the "family-plan" health and dental
coverages for employees and their dependents as specified in any current
operative Memorandum of Understanding between the City and a recognized
employee organization.
D. Tuition Reimbursement. Confidential employees shall
continue to be eligible to participate in the existing Training and
Education Assistance Program provided for all regular, full-time
employees of the City; except, however, reimbursement for eligible
employees shall be one hundred percent (100%) of tuition and registration
costs up to a maximun of five hundred dollars ($500.00) per semester in
accordance with the provisions of tb~t Program.
E. WelLness and Physical Fitness Incentive. Confidential
employees shall be eligible to receive cash payment to defray a portion
of the membership cost of a City-approved but privately operated health
and physical fitness program in accordance with the following
cost-sharing schedule: 80% of the annual membership cost up to a maximu~
City contribution of $500 per year.
F. Other Ccmpensation Plan (~%anges. Confidential
employees shall continue to be subject to the same changes in provision
pertaining to advancements and reductions in salary steps; temporary
upgrade assignment pay; overtime pay; vacation leave usage; residency
limitations; and implementation of a retiree health insurance program, if
and when developed, as provided or will be provided to represented
non-management, general service employees on or after July 1, 1989.

BE IT FURTHER RESOLVED: That Section 13 of Resolution _No.
82-110 is hereby amended as follows:
Section 13. Other Oc~fidential Employee Rights and Privileges.
Each employee in a class of ~ployment designated in Section 3 of this
Resolution as Unaffiliated Confidential (UC), shall continue to enjoy the
same rights and privileges to which they were entitled as of June 30,
1990.
BE IT FURTHER RESOLVED: that this Resolution shall be operative
frcm and after July 1, 1990.
