On motion of Councilman Helnly, seconded by Hub- bard and carried, the following Ordinance entitled: "Ordinance amending Article IX of the Santa Ana Municipal Code to change district classification on Amendment Application No. 353 and amending Sectional District Maps tl-5-10 and 12-5-10 (Exhibit AA 353A)" was introduced, considered and placed on file for second reading. This being the date set for hearing on Amendment Application No. 35~, filed by Baxter Joe Young, amending Sectional District Map ll-5-10, to reclassify from the M-1 to the R-2 District, property situated on the north Side of Second Street, be- tween Artesia and Western Streets, all as shown on Exhibit 354-A; no protests were received and the hearing was closed. On motion of Councilman Heinly, seconded by Hubbard and carried, the following Ordinance entitled: "Ordinance amending Article IX of the Santa Ana Municipal Code to change district classification on Amendment Application No. 354 and amending Sectional District Map ll-5-10 (Exhibit AA 354 A)" vas introduced, considered and placed on fils for second reading. Annex consisting of appreximately 206.6 acres, extending south from the center line of Edinger Avenue, beginning at a point approximately 1534 feet west of Bristol ,, Cu~m~nication was presented from the Planning C6,,-~ission advising of adoption of a plan for handling storm runoff waters within the City Limits, consisting of storm drain facilities, which is part of the Public Services Element of the General Plan of Co.~nlty Development. On motion of Councilman Heinly, seconded by Hubbard and carried, the co~aunication was received, filed, and the Clerk instructed to a Notice of Public Nearing, setting the date on August 7, 1961. Appeal Application No. 29 of Thyra M. Swales was again presented on Variance Appli- cation No. 1501, to erect a professional office building with a reduced north side yard, and to build an addition to same with a reduced south side yard, on property at 2020-2024 No. Broadway, in the "P" District, wherein applicant appeals planning Commission's condition that the west building wall contain translucent glass. Hal Davis, 718 E. Santa Clara Avenue, representing Mr. H. H. Reisman, new owner of said property, stated the Variance did eliminate the north and south side yards, the property would be divided into two lots, and there would be no change in the plans for the first building. Robert H. Jacobs, 2002 Victoria Drive, on behalf of Mrs. W. V. Treadwell and other interested property o~mers on Victoria Drive, pro- tested the unlimited height type of development in strip zoning, and requested the adoption of an emergency Ordinance preventing buildings of more than two stories in height being developed, stating the private rights of the residents are being adversely affected, and the condition imposed by the Planning Commission for trans. lucent glass should be required to maintain privacy in the backyards. Also, com- mercial parking and traffic would flow over into Victoria Drive and other streets if multi-story Buildings are permitted. Ramona Dri. ve, protesting the proposed four-story building in the 2000 bloc. North Broadway, and stating that no building over two stories should be allowed adjacent to a residential area, and on motion of Councilman Brewer, seconded by Hubbard and carried, the c~mm~nication was received and filed. Mrs. W. V. Tread- well, 2019 Victoria Drive and Dcm Franklin, 1617 E. 15th Street, requested action on the matter be tabled until the report of the Planning Department on multi- story structures is studied. Mr. H. H. Reisman, 1608 No. Spurgeon Street, stated that when he purchased the property it was zoned for professional use, the plans were approved by the Planning Commission, and requested that the Variance be grant. ed without translucent windows as originally planned, or denied cGnpletely. Mr. Clarence Hoiles, 2010 Victoria Drive, stated he was not objecting to the use of th~ property, and felt that the owner should use his property as he wished. Mrs. Her- bert Stroschein, 2226 Victoria Drive, inquired as to what provisions were being made for parking for the proposed building, and her questions were satisfactorily answered by the Planning Director. Mrs. B. E. Lindley, 2024 Victoria Drive, and Mr. A. A. Famalaro, 2322 So. Ramona Drive, stated the area is being rezoned out of an attractive residential environment, and a four-story building would only be the start for other tall buildings. The Council having unanimously waived the reading of the Resolution, on motion of Councilman Hubbard, seconded by Schlueter and car- ried, the following Resolution entitled: "Resolution No. 61-179 granting Variance on Application No. 1501 of Thyra M. Jackson, dated July 5, 1961, to construct an electric sign in front of 618 North MAin Street, which extends over and upon the established setback line, With the County, dated July 17, 1961, covering premises described as Room 211 and a portion of Roc~ 210 at ll04 W. Eighth Street, occupied by the County ^gri- cultural Co~issioner, and said Lease as extended December l, 1959 be terminated effective July l, 1961; and With the County, dated July 17, 1961, covering certain roems at 1104 W. Petitions were presented signed by approximately 170 persons protesting the Departq ment of Public Works' letter dated June 22, 1961, requesting the removal of plants walls, fences, etc. by October 1, 1961, which would interfere with pedestrian move ment. (Extension of time to paint elevated water tank) ~ ~ there will be no obstructions in a public easement area, and there is no way to change the statute, or interfere with the Penal Civil Code. The Manager verbally explained there is no opportunity for the City Council to take action which would permit the people to keep the obstructions in place, as the City is required to keep open a five-foot pedestrian area clear and safe from hazards, and the City has been placed on formal notice of liability if a person is injured by an obstruction in the easement area, or by a car because it was necessary to walk in the street. Side%talks are not involved, and the City does not require the construction of side- walks in this area, which would be placed Only at the request of the majority of th property owners. On motion of Councilman Hubbard, seconded by Heinly and carried, the petitions were received and filed. Hubert Schmieder, 2326 W. Monica Lane, re- presenting a group of property owners in the vicinity, asked questions concerning the clearance of the right-of-way, which were answered by the Manager. A commamica- tion was presented from Mrs. MarJorie Waite, 2321 W. Monica Lane, protesting the letter frc~ the Department of Public Works, setting forth certain questions, and motion of Councilman Hubbard, seconded by Heinly and carried, the ccmmmnication received and filed. Mrs. Waite stated sidewalks are not desired in the area and the removal of plantings, etc. would represent a financial hardship, and posed cer- tain questtuns which were answered by the Manager. Verbal protests were received from Chester Lewis, 2302 No. Jetty Drive; Michael Mason, 2225 W. Monica Lane; and June Young, 2B21 W. Monica Lane, who read a communication from Mrs. Janice Olden- brook, 2~02 W. Marty Lane, requesting the City to initiate an assessmeut for side- walks in the area, for the safety of the many children who n~ play in the streets. On motion of Councilman Hubbard, seconded by Heinly and carried, the communication was received and filed. No further action was taken. On motion of Councilman Hubbard, seconded by Heinly and carried, the request of Voorheis-Trindle-Nelson, Inc. was granted, for an extension of one year to record Tentative Tract No. 3821, filed by Alco-Pacific Construction Company, creating 190 lots on the north side of Sugar Avenue, approximately 660 feet west of Verano Street, subject to conditions. On motion of Councilman Hubbard~ seconded by Heinly and carried, the Mayor was authorized to execute ChaD~e Order No. l, dated June 29, 1961, with W, J. Burke Construction Co., on Fire Station No. 3, located at Franklin and Myrtle Streets, and approval granted for two days extension of time, to deepen footings for middle masonry wall 8" and west wall of framed section 6", due to uncovered fill, in the amount of $171.36, amending total contract price in the sum of ~51,961.36. On motion of Councilman Hubbard, seconded by Heinly and carried, the written recom- mendation of the Manager, dated July lB, 1961, was approved for salary step in- creases for one employee, effective July l, 1961, and for eight employees, effect- ive August l, 1961. On motion of Councilman Hubbard, seconded by Heinly and carried, the request of the Department of Public Works was approved for payment to Boyle Engineering, in the sum of $5,200.00 for c~pletion of preparation of the Master Plan of Drainage report 'per agreement with the City approved June 15, 1960. On motion of Councilman Hubbard, seconded by Heinly and carried, the request of the Department of Public Works was approved, and an extension of time granted to July 21, 1961, to Edward ^. On motion of Councilman Hubbard, seconded by Heinly and carried, the request of Department of Public Works was approved for payment to the Northside Church of Christ, 123 south Broadway, in the sum of Si, BOB.75, covering City's share of improvements On Grand Avenue, 560 feet south of the center line of Santa Clsra Av- enue, in exchange for dedication of Grand Avenue to the ultimate width, and con- struction of curb, gutter, sidewalk and pavement; payment to be made after receipt of deed and completion of construction. On motion of Councilman Hubbard, seconded by Heinly and carried, the request of the Department of Public Works was approved for payment to Southern California Ed- ison Company, in the sum of $8,875.93, for the City's share of street and drainage improvements on Grand Avenue at the southeast corner of McFadden Avenue and Grand Avenue, in exchange for dedication of Grand Avenue to the ultimate width, construc. tion of a culvert structure, and construction of curb, gutter, sidewalk and pave- ment; payment to be made after receipt of' deed and completion of construction. On motion of Councilman Hubbard, seconded by Heinly a~d carried, the request of Purchasing Agent was granted for the demolition and removal of the Audio-Visual Building located at ll04A West Eighth Street. A report was presented from the Special Library Fact-Finding Committee with the rec~amendation that the Hoover and Wilson Library Stations be operated half of the present scheduled days until the first of January, 1962, for comparison with the bookmobile service and the City Council to review the results and take appropriate action. Chairman Kenneth Mitchell, representing the group, stated he had nothing further to add to the report as submitted. A Minority Report was presented and Wilber F. Eartman, lOO1 Grovemont Street, representing the ~inority group, request- ed a continuance to August 7, 1961, so that further evidence could be ~resented beneficial to the City libraries. On motion of Councilman Hubbard, seconded by Schlueter and carried, the reports were received, filed, and action deferred until August 7, 1961. Th~ matter of a noise nuisance from certain newly installed equipment at Arrow Laundry & Cleaners, 620 E. Sixth Street, which shakes the g~o~ud, has broken win- dows and caused other structural damage to buildings within a four-block area, was again presented for the City Attorney's determination as to whether or not the op- eration of the new equipment is a public or a private nuisance. The Attorney ly reported a determination had been made ar~a public nuisance exists, and on mo- tion of Councilman Hubbard, seconded by Brewer and carried, the Attorney was ted to take fmmediate legal action to abate the public nuisance emanating from the Arrow Laundry & Cleaners, and secure all evidence necessary to carry the case to a final conclusion.' Mrs. Robert G. Holccmb, 2211 East First Street, owner of the Wishing Well Motel, read a cu~aanication she had addressed to the Editorial Department, The Register, concerning the visit of two police officers, in the early morning hours, and the questioning of certain registered guests and the operation of the motel.
