RESOLUTION 90-096
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA ANA APPROVING
CONDITIONAL USE PERMIT NO. 90-8 TO
ALLOW SALE OF BEER AND WINE IN A
STORE LOCATED AT 3338 SOUTH BRISTOL.
WHEREAS, this Council held a public hearing on August 6,
1990, on Conditional Use Permit Application No. 90-008, which
sought to allow the sale of beer and wine for off-site consumption
in a store at 3338 South Bristol Street, which application came to
this Council on appeal following its denial by the zoning
administrator;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid
hearing, the City Council finds and determines as follows:
(a) The sale of beer and wine will be ancillary to the
primary function of the store, which is to sell imported and
specialty dry goods, bakery and delicatessen products.
(b)

The sale of beer and wine provides a neighborhood

and wine will not be detrimental to the health, safety, or welfare
of people in the vicinity, and will not adversely affect the
economic stability or development of the surrounding area.
(d) The proposed use will comply with all applicable
zoning regulations.
(e) The proposed use will not adversely affect the
general plan of the City.
2. Conditional Use Permit No. 90-008 is hereby approved,
subject to the conditions, requirements and limitations set forth
in Exhibit A, attached hereto and incorporated herein and subject
to the additional conditions (1) that the floor area devoted to the

sale of beer and wine shall not exceed ten percent of the total
floor area devoted to retail sales, and (2) that this conditional
use permit be subject to review every second year to determine
whether there is continuing compliance with the conditions of
approval.
