HomeMy WebLinkAbout91-020 REL: _RESOLUTION NO. 91- 020 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ESTABLISHING THE WILLARD PERMIT PARKING DISTRICT 2/5/91 WHEREAS, pursuant to Article XI (commencing with Section 36- 480) of Chapter 36 of the Santa Ana Municipal Code, the City Council of the City of Santa Ana is authorized to adopt resolutions establishing Permit Parking Districts wherein parking restrictions apply to all vehicles except vehicles which have been issued parking permits pursuant to said Article; and WHEREAS, this Council finds and determines that the Willard residential neighborhood is in need of parking restrictions to protect its integrity from the intrusion of vehicular parking incidental to commercial and governmental activities, to allow for adequate emergency vehicle access, to counter the visually blighting effect of highly intensive on-street parking, and to discourage overcrowding of dwelling units; and WHEREAS, it is necessary to provide for the exemption from such parking restrictions, through the provision of a permit parking system, for residents in single-family and two-family dwellings and for residents in federally funded low income rental projects, in order to avoid the undue hardship on such residents which would otherwise result due to the nonavailability of adequate on-site parking; and WHEREAS, it is necessary to extend such parking restrictions and corresponding permit parking system beyond the Willard neigh- borhood proper in order to protect nearby areas from increased demand for on-street parking due to the parking restrictions in the Willard neighborhood; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. The Willard Permit Parking District is hereby esta- blished, to consist of that area of the City of Santa delineated on the map attached hereto as Exhibit A and incorporated herein by this reference. 2. No person shall park any vehicle between the hours of 2:00 a.m. and 6:00 a.m. on any portion of any street within the Willard Permit Parking District as to which signs have been erected indicating the application of permit parking restrictions, except persons who are entitled to a permit to park on such street or portion thereof pursuant to this resolution and who display such permit in accordance with section 36-488(a) of the Santa Ana Municipal Code. 3. The Executive Director of Public Works is hereby authorized to determine which streets or portions thereof within the Willard Permit Parking District shall be restricted to permit parking in accordance with section 2 of this resolution and to post appropriate signs giving notice of such restriction. 4. The Executive Director of Public Works is further authorized to designate areas within the Willard Permit Parking District where permit parking privileges within any such area are limited to persons who reside within such area and who are otherwise eligible for a permit under this resolution. The Executive Director of Public Works may design and issue permits in a manner appropriate to effectively enforce any such limitation. 5. Persons entitled to a permit to park in locations subject to permit parking restrictions pursuant to this resolution include and are limited to the following: (a) Any person who is licensed to drive a motor vehicle and who resides in a single-family dwelling or a duplex (two-family dwelling) located on any lot in the Willard Permit Parking District which does 'not have more than two dwelling units located on it, provided that not more than two permits may be issued at any one time to the residents of any one dwelling unit. (b) Any person who is licensed to drive a motor vehicle and who resides in a low income rental housing project located within the Willard Permit Parking District which has received federal financial assistance or subsidy through the FHA Mortgage Assistance Program or the "Section 8" new construction program, provided such project continues to provide housing which is affordable to persons of low income, and provided further that not more than one permit may be issued at any one time to the residents of any one dwelling unit. 7. No guest parking permits shall be issued in the Willard Permit Parking District for exemption from the parking restrictions imposed by this resolution. 6. In that area of the City which is included in both the Washington Square Permit Parking District and the Willard Permit Parking District, the parking restrictions and permit system established by Resolution No. 87-57 of this Council for the Washington Square Permit Parking District shall remain in full force and effect in addition to. the parking restrictions and permit system established by this resolution for the Willard Permit Parking District; provided, however, the Executive Director of 2 Public Works may, where appropriate, design and issue a permit for persons eligible for permits in both districts.
