Present: Councilmen Absent: Councilmen Royal E.. Hubbard, Henry H. Schlueter, Dale H. Heinly, Bob Brewer, A. A. Hall None The Pledge of Allegiance was given. Invocation was given by Mr. Ralph Worsham, The Register. Each member of the City Council having received copies of the Minutes of September 18, 1961, reading of the Minutes was dispensed with and approved as mailed on motion of Councilman Hubbard, seconded by Schlueter and carried. Bids Paving Breakers with Accessories A tabulation of bids was again presented to furnish and deliver three Paving Break- ers with Accessories, Item (2), Specification No. 623-19, and on motion of Council- man Heinly, seconded by Hubbard and carried, all bids were rejected on Item (2) and the Purchasing Agent authorized to purchase the equipment through negotiation on the Bid Acceptance Truck Chassis with Cab open market. A tabulation of bids was presented to furnish and deliver one 24,000~ G.V.W. Truck International Harvester Co. Annex" Ordinance rejected. This being the date set for hearing on the annexation of property consisting of approximately 1~.726 acres, located at the northeast corner of Lincoln and Santa Clara Avenue, designated "Santa Clara and Lincoln N. E. Annex"; the Mayor asked the Clerk if any written protests had been received, and she replied there were none. The hearing was closed. On motion of Councilman Heinly, seconded by Hubbard aud carried, the following Ordinance entitled: "Ordinance declaring the annexation of territory designated 'Santa Clara and Lincoln - N. E. Anuex'" Hearing "Seventeenth and Mabury North Annex" Ordinance was introduced, considered and placed on file for second reading. This being the date set for hearing on the annexation of property consisting of approximately 19.137 acres~ located 831 feet east of the center line of Wright Street and north of the intersection of Seventeenth and Mabury Streets, designated "Seventeenth and Mabury North Annex"; the Mayor asked the Clerk if any written pro- tests had been received, and She replied there were none. On motion of Councilman Brewer, seconded by Hubbard and carried, the following Ordi- nance entitled: "Ordinance adopting by reference a plumbing code known as 'Orange Empire Plumbing Code - 1961' providing for the protection of the public health and safety, and the quali- fication and registration of persons engaged in the busi- ness of plumbing, or laboring at the trade of plumbing; requiring permits and inspections for the installation or alteration of plumbing and drainage systems; defining certain terms; establishing minimum regulations for the installation, alteration or repair of plumbing and drainage systems and the inspectioa thereof; providing penalties for its violation; and repealing conflicting Ordinances; and amending Sections 8200, 8201 and 8202, and repealing Sections 820~, 8204, 8205, 8206, 8207, 8208, 8209, 8212, 8213, 8214, 8215, 8216, 8217, 8218, 8219, 8220, 8220.1, 8221, 8222, 8223, 8224, 8225, 8226, 8227, 8228, 8229, 8230, 8231, 8232 and 8233 of Chapter 2, Article VIII ~the Santa Ana Municipal Code" was introduced, considered and placed on file for second reading. This being the date set for hearing on Amendment Application No. 362, filed by R. GJ Holccmb, amending Sectional District Map 8-5-9, to reclassify from the R-1 to the R-3H District, property on the north side of First Street, between Tustin Avenue and Mabury Street, all as shown on Exhibits AA 362A, AA 362B and AA 362C; no protests were received and the hearing was closed. On motion of Councilman Heinly, seconded by Brewer and carried, the following Ordinance entitled: "Ordinance amending Article IX of the Santa Ana Municipal Code to change district classification on Amendment Application No. 362 and amending Sectional District Map 8-5-9 (Exhibit AA 362 C) was introduced, considered and placed on file for second reading. On motion of Councilman ~e inly, seconded by Brewer and carried, the reco~mzendation of the Planning Department was approved and the request of Paul Calvo, Agent for owner, granted, for an extension of time from October 17, 1961 to October 17, 1962, on Tentative Tract Map No. 3921, filed by Westport, Ltd., creating 70 lots located between Fairview and Sullivan Streets on the north side of Willits Street, subject to conditions. Appeal Applicatiou No. 37 of The First Church of God of Santa Aha, was presented on Conditional Use Permit Application No. 62, to establish a new church development on property at 42~ South Newhope Street, in the R-2 District, wherein Applicant appeal~ condition (10): "That there be a six-foot solid masonry wall around the entire par~- ing area terminating at the 20-foot front yard setback (no wall at driveway entran- ces),'' and proposes that the required masonry wall should be constructed only on such property lines as may abut residential uses and on such property that is presemt- ly being considered for development of said Church. Joseph Columbo, Architect, 2132 North Main Street, stated the Church had deeded property to the City for drainage, street purposes, and sewer easements, and objected to Condition (lO),reference the construction of a six-foot masonry wall along the frontage of the northwest portion of the property, as a burden at this time. Also, there is another parking lot for the school and no masonry wall was required for that property. Saucedo was presented on Variance Applica- tion No. 1536, to convert a family recreation building into a bachelor apartment, on property at 1618 W. 4th Street, in the C-1 District, wherein Appellant states: "Started recreation building in 1957 and in 1959 wanted to change to a small apart-' ment and learned on final inspection that the zone had changed." Mr. Saucedo sta- ted that during the course of constructing a recreation building in 1957, he in- quired about the conversion to a small rental apartment and was informed that as the area was zoned C-2 this would be satisfactory. When the building was recently cGmpleted, at considerable expense, it was found that the zone had been changed and final inspection was denied. Mr. Saucedo stated his brother has recently married and wculd like to rent this apartment. Eddie Munoz, 1622 W. 4th Street, and Rober~ Munoz, 1626 W. 4th Street, objected to rental by a bachelor because of the young children in the area and a school is located within approximately 300 feet. Martinl Saucedo, 912 W. Fifth Street, stated he is the recently married brother and would like to rent the apartment. Marcellus B. Long, 1631 W. 4th Street, inquired about the zoning for a bachelor apartment, and whether the entire area would have to be changed from C-l, if this Appeal is granted. Mr. D. C. Espinosa, ltl0 W. 4th Street, stated he has known Mr. Saucedo for many years and considers him to be a respectable member of the community, who would not rent the apartment to an undesirable person. On motion of Councilman Hubbard, seconded by Schlueter and carried, the recommenda- tion of the Zoning Admfuistrator was approved, and Appeal Application No. 38, filed by Manuel G. Saucedo, denied. Hoy, Engineer, 844 North Birch Street, rel~reaenttng' Harry Tancredi, stated the conditions imposed were acceptable with exception of condition (6) "That Wright Street be paved to City standards a minimum width of lO feet east of and l0 feet west of the center line from the southerly boundary of this tract to Seventeenth Street; that the improvement plans be included with the improvement plans for the tract." Mr. Hoy stated there was no objection to improving Wright Street on the west side of the street down-to 17th Street, but objected to paving the east side of Wright Street, thereby improving property he does not own. The Director of Public Works satisfactorily answered his questions. On motion of Counc~lm-~ Reinly, seconded by Hubbard and carried, Tentative Tract Map No. 4404 filed by Harry Tancredi, was approved subject to all conditions except Condition 6, and that Wright Street be paved to City standards a minimum width of ten feet west of the center line and the southerly boundary of the Tract to 17th Street; that improvement plans be included with the improvement of the tract and wh~ re the elevation is irregular, said irregularity sba]l be removed. Communication was presented from Don Woodward, Inc., requesting permission to substitute a bond in the sum of $47,000.00 covering Final Map of Tract No. 3374, filed by Farmers Security Come, any, due to purchase of the property and map from party now providing the ~xiginal bond. On motion of Councilman Hubbard, seconded by Brewer and carried, the request was approved to substitute a bond in the sum of $47,000.00 covering Final Map of Tract No. 3374 filed by Farmers Security Company, on property located between Memory Lane, Flower Street and the Santa Ana Freeway, creating 37 residential lots and one large site, subject to approval of the bond by the Attorney as to form, and agreement covering improvements ordered signed. On motion of Counc~lm-u Hubbard, seconded by Brewer and carried, proper officials were authorized to execute agreement with Santa Aha Neon Company, Frank and Mary Batitis, dba Frs Mar Restaurant, and Mrs. Ruby McFarland, to construct an electric sign in front of property at 4414 Westminster Avenue, which extends over and upon the established setback line. It was moved by Counci]m-n Hubbard, seconded by Brewer and carried, that escrow instructions No. 46606-C, dated August 18, 1961, be approved and signed with Pacifi, Theatres Develolmment Cempany, for street easement on the west side of King Street, north of Fifth Street, in the amount of $846.00. The Council having unanimously waived the reading of the Resolution, on motion of Counci]m-n Hubbard, seconded by Brewer and carried, the following Resolution entitled: "Resolution No. 61-233 accepting deed where the City is paying a cash consideration" from Pacific Theatres Development Company, a California Corporation, for street easement on the west side of King Street, north of Fifth Street, in the sum of $8~6.00, was considered and passed by the following vote; Ayes, Counc~-~n Royal E. Wilhelmi, 2028 Greenleaf Street stated m,~y children must cross 19thStreet going to and from Jefferson School, and due to the fast traffic, requested the installation of a stop sign on 19th Street at Oreenleaf Street for the safety of the school children. Mrs. Patricia G. Nevils, 1618 Oreenleaf Street, stated n,~-a~rous serious accidents have occurred at this intersection and the speed of the traffic is increasing daily. On motion of Councilman Hubbard, seconded by Heinly and carried, the Manager was instructed to negotiate with Gethsemani Methodist Church of Santa Ana, for rental of property at 709 W. 6th Street, at a rental of not less than $250.00 per month, and the City to be entitled to possession of the property after three-monthS' notice proper authorities authorized to execute a rental agreement with the Church at the price and under the terms provided, also providing for a three-months' revocation notice.
