Home My WebLink About91-026327 REL:mb 2/14/91 RESOLUTION NO. 91-026 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 28. WHEREAS, by Minute Order dated February 4, 1991, a public hearing was called for March 4, 1991, at the hour of 7:30 p.m., at the Council Chambers of the city Hall, 22 Civic Center Plaza, Santa Ana, California, to ascertain whether the public necessity, health, safety, or welfare required the removal of poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electrical communication or similar or associated service, for the formation of the Underground Utility District No. 28 within that certain area of the City described as follows: That portion of the area within the Santa Ana City Limits bounded northerly and southerly by lines 85 feet from the centerline of Westminster Avenue, westerly by the centerline of Euclid Avenue, and easterly by the centerline of Fairview Street. WHEREAS, notice of such hearing has been given to all affected property owners as such are shown on the last equalized assessment roll and to all utilities concerned in the manner and within the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Ana: 1. That pursuant to Santa Ana Municipal Code Sections 37-1 to 37-13, the above-described area is hereby declared an Underground Utility District and is designated as Underground Utility District No. 28 of the City of Santa Ana. Attached hereto, marked Exhibit "A", and hereby incorporated as a part of this Resolution, is a map delineating the boundaries of said District. 2. That the City Council does hereby fix December 1, 1992 as the date on which affected property owners must be ready to receive underground service, and does hereby order the removal of all poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service within Underground Utility District No. 28 on or before June 15, 1993. 3. That the City's Rule 20A Allocation will be charged for installing up to 100 feet of each customer's service lateral. 328 Undergrounding of individual electric services in excess of 100 feet will be at the expense of the property owner. 4. That the Clerk of the Council is hereby instructed to notify all affected utilities and all affected property owners within Underground Utility District 28 of the adoption of this Resolution within ten (10) days after the date of such adoDtion. Such notification shall be made by mailing a copy of this Resolution, together with a copy of said Santa Ana Municipal Code Sections 37-1 to 37-13 to all affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. 5. That the City Council of the City of Santa Ana hereby finds and determines as follows, upon the basis of the evidence presented at said hearing; that the public necessity, health, safety, and welfare require the removal of poles, overhead structures within said area of the City, and the underground installation of wires and facilities for supplying electric, communication, and similar or associated services, so as to eliminate hazards caused by fallen lines and poles and to improve visibility of pedestrian traffic to vehicle drivers.
